South Bend Redevelopment Commission <br />Regular Meeting —June 6, 2003 <br />6. NEW BUSINESS <br />A. Public Hearing <br />(1) continued.... <br />The property that is owned by the Emmett <br />McNease Revocable Living Trust at 418 and <br />424 -430 South Main Street, South Bend, is <br />used as the parking for the building owned <br />by the Emmett McNease Revocable Living <br />Trust at 439 South Michigan Street, South <br />Bend. This building houses the Witmer <br />McNease Music Company, Inc., Ralph's <br />Newsstand and seventeen other tenants. <br />There also are ten (10) to fifteen (1 S) <br />monthly parkers who pay to use the parking <br />lot. The Redevelopment Commission's <br />action to take the parking lots will <br />substantially damage the building at 439 <br />South Michigan Street, which is not being <br />acquired, and the businesses located in that <br />building. <br />The Redevelopment Commission's action is <br />a prelude to taking property from a private <br />owner to transfer to another owner. This <br />action exceeds the statutory authority of the <br />Redevelopment Commission and violates the <br />constitutional rights of Emmett McNease <br />Revocable Living Trust. <br />Emmett McNease Revocable Living Trust <br />remonstrates against the inclusion of its <br />property in the proposed amendment to the <br />South Bend Central Development Plan.
