South Bend Redevelopment Commission <br />Rescheduled Regular Meeting— November 17, 2003 <br />6. NEW BUSINESS (CONT.) <br />C. Sample -Ewing Development Area <br />(1) continued... <br />Mr. Laurent reported that the Access and <br />Indemnification Agreement was the <br />Commission's standard form. On <br />November 13, 2003, the Commission and <br />Rose Fuel closed on the property, including <br />the Oliver boilerhouse and smokestack, <br />which is now 918 Oliver Plow Court. As a <br />result of our ongoing renovation and <br />stabilization activities at that site, we still <br />have approximately two to three weeks of <br />work remaining. Now that Rose Fuel owns <br />the property, the Commission will be <br />indemnifying Rose Fuel for our contractor's <br />work on site. Due to slow response from <br />Rose Fuel & Materials legal counsel, we <br />have not received their comments on the <br />access agreement. Two forms are being <br />presented in order to expedite orderly <br />completion of the project. Staff is <br />requesting the Commission execute both of <br />its standard forms, the short version and the <br />long version for Access and Indemnification. <br />Staff will have the appropriate form signed <br />by the Rose Fuel organization. <br />Mr. Hunt asked if this action was approved <br />by legal counsel. <br />Ms. Greene responded that it was, and both <br />forms were standard in content. The <br />Commission will indemnify the developer <br />for any actions or harm caused by the <br />Commission in their activities. <br />L <br />
