<br /> access to a church, school or other public building or place. The vacation would not hinder the
<br /> use of a public right-of-way by the neighborhood in which it is located or to which it is
<br /> contiguous. Community & Economic Development stated they approve the recommendation
<br /> with some reservation about sufficient neighborhood access. They noted the only direct access
<br /> from the alley to a parking area is at 202 North Wellington. Approval of the vacation would
<br /> allow Petitioner to consolidate her property at 202 North Wellington with the property to the
<br /> south, 146 North Wellington, which she also owns. Engineering stated they have reservations
<br /> regarding the vacation satisfying the petitioner's safety and security goal. It was noted a fence on
<br /> the property would be less expensive and more affective. NIPSCO has no objections as long as
<br /> the north-south alley remains as is.
<br /> Therefore, Mr. Littrell made a motion that the Clerk send a letter to the petitioner recommending
<br /> approval of the request for vacation subject to the petitioner removing the existing approach and
<br /> alleyway concrete. Mr. Littrell recommended it would be easier to put up a security fence. Mr.
<br /> Inks seconded the motion which carried.
<br /> FAVORABLE RECOMMENDATION - RELEASE OF PORTION OF WATER MAIN
<br /> EASEMENT - IRISH CROSSINGS DEVELOPMENT AT 54692 BURDETTE STREET AND
<br /> 54697 IRISH CROSSING DRIVE WEST
<br /> In a memorandum to the Board, Mr. Anthony Molnar, Division of Engineering, asked that a
<br /> portion of the above referenced existing municipal water main easement be released for Danch,
<br /> Harner & Associates, Inc., 1643 Commerce Drive, South Bend, Indiana 46628, on behalf of their
<br /> client, Stone Manor Investment Corp., to prevent an encroachment of recently purchased
<br /> properties at 54692 Burdette Street and 54697 Irish Crossing Drive West. Mr. Molnar advised
<br /> the Board he is in receipt of favorable recommendations concerning this Release of a Portion of
<br /> the Easement from the Water Department and Engineering. Therefore, upon a motion made by
<br /> Mr. Inks, seconded by Mr. Littrell, and carried, the above referenced release of a portion of the
<br /> water main easement was approved.
<br /> APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO
<br /> REMONSTRATE-- 17720 BULLA ROAD —WATER
<br /> Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Rights to
<br /> Remonstrate as submitted by Winifred Melton, 17720 Bulla Road, South Bend, Indiana 46635.
<br /> The Consent indicates that in consideration for permission to tap into public water system of the
<br /> City, to provide water service to the above referenced property at 17720 Bulla Road, South
<br /> Bend, Indiana 46635, Lot 121 of Wilmette Park Subdivision located on the south side of Bulla
<br /> Road, east of 27"' Street, (Key 4 002-2117-5767), Ms. Melton waives and releases any and all
<br /> right to remonstrate against or oppose any pending or future annexation of the property by the
<br /> City of South Bend. Therefore, Mr. Inks made a motion that the Consent be approved. Mr.
<br /> Littrell seconded the motion, which carried.
<br /> RATIFY APPROVAL AND/OR RELEASE CONTRACTOR EXCAVATION AND
<br /> OCCUPANCY BONDS
<br /> Mr. Anthony Molnar, Division of Engineering, recommended'that the following Contractor,
