Staff has also sought input from the <br />City's Department of Public Works Director <br />and City Engineer to see if they were aware <br />of any additional repairs or maintenance <br />needed for the facilities covered by these <br />documents, and there were none. Staff also <br />checked with a representative of Scott <br />Herczeg, Director of Operations & Building <br />Engineer for Century Center. Scott was not <br />aware of any maintenance or repairs required <br />of Host of FBCLP under the documents. A <br />representative of 1St Source Bank is also <br />being contacted, but was not available at the <br />writing of this report. <br />Staff recommends approval of the <br />Certification and Release. <br />Mr. Richard Nussbaum noted that Operation, <br />Maintenance and Easement Agreement is a <br />natural result of the Memorandum of <br />Understanding the Commission approved last <br />December. Built into the MOU was the <br />possibility that the current owner of the hotel <br />building would sell their interest to another <br />party. They have sold it to another party and <br />are in the process of closing that sale. The <br />documents the Commission had to review are <br />documents required as part of that closing. <br />There are certain agreements in regard to the <br />operation and the maintenance of common <br />areas in the building and around the building <br />— the 1St Source Bank and Marriott building. <br />The major parties required to comply with <br />those agreements are the owner of the 1St <br />Source Bank building, a limited partnership <br />16 <br />
