Redevelopment Commission Meeting <br />IL Rescheduled Regular Meeting— October 8, 2004 <br />6. NEW BUSINESS (CONT.) <br />H. South Side Development Area <br />(1) Commission approval requested for <br />execution of an Authorization for Entry <br />Upon Public Property for Erskine Village <br />Shopping Center Project. <br />Ms. Greene noted that the Commission <br />offered the property through its standard <br />disposition process under I.C. 36- 7- 14 -22. <br />She confirmed that no bids were received as <br />of the bid call -in date of October 1, 2004 and <br />no bids had been received as of the October 8 <br />rescheduled meeting date. The Commission <br />must now wait thirty days before selling the <br />property by a negotiated sale. <br />This property is on the back edge of the <br />Erskine Village Shopping Center site. The <br />developer, KSK Scottsdale Mall LP, has <br />expressed an interest in purchasing this <br />property through a negotiated sale. In the <br />interim KSK would like access to the <br />property to do some work. This <br />authorization would allow KSK Scottsdale <br />Mall to proceed work, pending the thirty <br />days that the statute requires for a negotiated <br />sale. If the parties are not able to reach a <br />negotiated agreement with KSK, KSK will <br />be required to indemnify the Commission for <br />any damages to the property. <br />Mr. Inks inquired when the thirty -day period <br />begins. Ms. Greene responded that the 30 <br />day period starts October 8, 2004 which is <br />the date that the Commission would have <br />opened and considered any written offers. <br />Under IC 36- 7- 14- 22(h), no sale or lease of <br />the property may be made for 30 days "after <br />the opening of the written offers ". <br />26 <br />
