Area Board of Zoning Appeals—June 1, 2411 <br /> MR. URBANSKI: If you get denied by the South Bend City Council to change it back to a duplex. So <br /> we're going to vote on the variances. If the variances get approved then the recommendation we have to <br /> make to the South Bend Common Council is whether we send it with a favorable recommendation, <br /> unfavorable or no recommendation. Because we send it with a favorable it doesn't mean that they will turn <br /> it down or vice versa. We can send it with no recommendation or unfavorable and they can approve it. But <br /> by us voting separately for the variances and if they get approved at least you will not have to come back <br /> here again. <br /> MR. GIVENS: Okay. <br /> MR. PHIPPS: Jim, does the Building Department have any experience with Mr. Givens, are you familiar <br /> with his work or...? <br /> MR. MARKLE: If he's a registered contractor he's just like every other contractor, we don't have testing for <br /> contractors. Are you a registered contractor sir? <br /> MR. GIVENS: No. <br /> MR. URBANSKI: If he's working on his own homes he wouldn't have to be then. <br /> MR. PHIPPS: Jim so you have no experience with him? <br /> MR. MARKLE: No experience. <br /> MR. GIVENS: I went to school for carpentry with the union up in Warsaw. And what I can't do I hire <br /> people to do. Electricity, plumbing and... <br /> MR. URBANSKI: It seems to me if he's pulling permits that he has to... <br /> MR. GIVENS: Yes we are licensed and bonded and insured. <br /> MR. URBANSKI: Any questions or is there a motion? <br /> A motion for approval of the variances was made by Mr. Phipps and seconded by Mr. Velleman. The <br /> motion carried unanimously. <br /> MR. URBANSKI: Do we now a motion on the Special Exception? The staff recommends a Favorable <br /> Recommendation. <br /> MR. PHIPPS: Mr. Chairman it's an uncomfortable position that we're in and difficult decision to essentially <br /> take someone's property away from them or take their value away from their property, although there <br /> certainly would be grounds if they haven't cared for it in that year that that would be reasonable but Mr. <br /> Givens has I guess given some explanation as why he hasn't.
