REGULAR MEETING JUNE 13, 2011 <br /> <br /> <br /> <br />BILL NO. 28-11 PUBLIC HEARING ON A BILL OF THE <br /> COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA, AMENDING CHAPTER 17, <br /> ARTICLE 2, DIVISIONS 1,3,4 AND 6 OF THE <br /> SOUTH BEND MUNICIPAL CODE TO <br /> INCORPORATE THE ENVIRONMENTAL <br /> PROTECTION AGENCY (EPA)’S MODEL <br /> PRETREATMENT ORDINANCE <br /> <br />Councilmember Oliver Davis, Chairperson, Utilities Committee, reported that this <br />committee held a meeting this afternoon and it was the consensus of the committee to <br />send this bill to the full Council with a favorable recommendation. <br /> <br />Al Greek, Division Director, Environmental Services, 3113 Riverside Drive, South Bend, <br />Indiana, made the presentation for this bill. <br /> <br />Mr. Greek advised that this bill would allow for the revision of Chapter 17, Article 2, <br />Divisions 1,3,4 and 6 of the South Bend Municipal Code which regulates the use of and <br />industrial discharge to public sewers. The revision is a requirement of the City of South <br />Bend’s National Pollutant Discharge Elimination System permit to implement an <br />approved Industrial Pretreatment Program. Changes in federal pretreatment regulations <br />mandate a revision to Chapter 17. In addition, discharge limitations have been revised <br />for PH and arsenic to protect the environment and South Bend’s publicly owned <br />treatment works. The format and order of Chapter 17 have also been revised in order for <br />it to be easier for both South Bend staff and local industry to read and implement. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable <br />recommendation to full Council concerning this bill. Councilmember Oliver Davis <br />seconded the motion which carried by a voice vote of eight (8) ayes. <br /> <br /> <br />BILL NO. 25-10 PUBLIC HEARING ON A BILL OF THE <br /> COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA, AMENDING VARIOUS <br /> SECTIONS OF CHAPTER 2, ARTICLE 6 OF <br /> THE SOUTH BEND MUNICIPAL CODE <br /> PERTAINING TO TAX ABATEMENTS <br /> <br />Councilmember Dieter made a motion to strike this bill from consideration. <br />Councilmember Varner seconded the motion which carried by a voice vote of eight (8) <br />ayes. <br /> <br /> <br />BILL NO. 27-11 PUBLIC HEARING ON A BILL OF THE <br /> COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA APPROPRIATING $9,150,000 <br /> FROM MAJOR CAPITAL INVESTMENT <br /> PROJECTS IN 2011 <br /> <br />Councilmember Dieter made a motion to accept the substitute version of this bill as on <br />file in the Office of the City Clerk. Councilmember Varner seconded the motion which <br />carried by a voice vote of eight (8) ayes. <br /> <br />Councilmember LaFountain, Chairperson, Personnel & Finance Committee, reported that <br />the committee held a meeting this afternoon and voted to send items #2, #3, and #4 to the <br />full Council with a favorable recommendation, however, item #1 was sent with no <br />recommendation. <br /> 9 <br /> <br />
