URBANSKI: Sir out of eleven houses you said you had purchased, how many are left to be remodeled, <br /> to have work on them, besides this duplex in question now? <br /> MR. GIVENS. Well when we said eleven I was counting the one we voluntarily tearing down so that would <br /> be bring it to ten, so we ain't going to count that one, so three left. We've got to finish our building that I'm <br /> going to turn into barber shop into the neighbor and then neighborhood a barber shop right there on the <br /> corner of Linden and Studebaker. I got put the siding on in the next couple of weeks. So we've got three to <br /> finish. <br /> MR. URBANSKI: Okay. <br /> MR. GIVENS: That will be the third on so the building, the one at 112 and the one on Washington Street, <br /> MR. URBANSKI: Okay, thank you sir. Any other questions from Board or staff or is there a motion? <br /> MR. FEDDER: Well first of all you've got to realize that you got the double thing here. There's a request <br /> for three variances. In addition to that this is a matter that's going to be referred to the South Bend Common <br /> Council so you'll only be in a position to make a favorable, unfavorable or no recommendation. As we have <br /> in the past I would suggest that if you're going consider granting the variances that you make those variances <br /> subject to the final authority by the South Bend Common Council. I don't know that this gentleman under <br /> stands it but this Board can only give a recommendation. This matter then has to go on to the South Bend <br /> Common Council who has final approval so if they approve the classification, so be it. If they do not then <br /> the request for the variances would also fall even though they may give you temporary approval for the <br /> variances it would be subject to final approval by the South Bend Common Council. <br /> MR. VELLEMAN: Well do we really have to do that? Because if they don't approve the Special Exception <br /> and it converts back to single family and someone still wants to rehab the house, they still have to have the <br /> variances. <br /> MR. FEDDER: So, you're correct. <br /> MR. VELLEMAN: So we don't have to make it subject to the Special Exception? <br /> MR. FEDDER: No, you don't have to. <br /> MR. URBANSKI: Do you understand what we're saying Mr. Givens? <br /> MR. GIVENS: No sir. <br /> MR. URBANSKI: Some of the variances that you are asking for need to be in place even if you turn into a <br /> one family unit. <br /> MR. GIVENS: Okay. <br /> 22 <br />
