1 <br /> . � <br /> e,7 +,. +l,o , �r+l,o ,,,,+;,,., „�+L.o r;r., <br /> The City ma�pt reasonable fees for reimbursement of costs of setting up and <br /> operatin�the City's Pretreatment Program, which ma�include: <br /> � Fees for wastewater dischar�e permit applications including the cost of <br /> ,processin sg uch applications; <br /> � Fees for monitorin�spection, and surveillance procedures includin�the <br /> cost of collection and analyzin� a User's discharge, and reviewin� monitorin� <br /> reports and certification statements submitted bv Users. All Users shall incur a <br /> minimum fee of one hundred dollars ($100.00) for sample collection activities <br /> performed bv Cit�personnel; <br /> � Fees for reviewing and respondin� to accidental dischar�procedures and <br /> construction• <br /> � Fees for filing appeals; <br /> � Fees to recover administrative and legal costs (not included in the above <br /> Subsection L) of this Section 17-15)associated with the enforcement activity <br /> taken bv the Director to address IU noncompliance; and <br /> �f Other fees as the City may deem necessary to carry out the requirements <br /> contained herein. These fees relate solelv to the matters covered by this ordinance <br /> and are separate from all other fees, fines, and penalties char ea�bv the Cit� <br /> If an�provision of this ordinance is invalidated bv any court of competent jurisdiction, <br /> the remainin�,_provisions shall not be affected and shall continue in full force and effect. <br /> SECTION XI. Chapter 17, Division 3, existing Sections 17-12 and 17-13 of the South Bend <br /> Municipal Code are now combined and renumbered as Section 17-16, and this combined Section <br /> 17-16 is now amended to read in its entirety as follows: <br /> Sec. 17-1�6. ���e Cooling waters. <br /> � Unpolluted coolinQ waters <br /> Unpolluted water from air conditions, cooling, condensing systems or swimming pools <br /> shall be discharged to a storm sewer, where it is available, or to a combined sewer approved by <br /> the City. Where a storm sewer is not available, discharge may be to a natural outlet approved by <br /> the City Engineer and by the State of Indiana.
