<br /> Information and data on a User obtained from reports, surve �}�s,
<br /> wastewater dischar�e permit applications, individual wastewater dischar�e
<br /> permits and monitorin� pro�rams, and from the Director's inspection and
<br /> sampling activities shall be available to the public without restriction,
<br /> unless the User specificall�c�uests, and is able to demonstrate to the
<br /> satisfaction of the Director, that the release of such information would
<br /> divul�e information processes or methods of production entitled to
<br /> protection as trade secrets under the Indiana Access to Public Records Act
<br /> (I.C. 5-14-3-4(a)(4)). Any such reQUest must be asserted at the time of
<br /> submission of the information or data. When requested and demonstrated
<br /> � the User furnishin� a report that such information should be held
<br /> confidential the portions of a report which might disclose trade secrets or
<br /> secret �rocesses shall not be made available for inspection b�public,
<br /> but shall be made available immediatel�pon request to governmental
<br /> a�encies for uses related to the NPDES pro ra� or pretreatment pro rg am,
<br /> and in enforcement proceedin�s involving the person furnishin t�port.
<br /> Wastewater constituents and characteristics and other effluent data, as
<br /> defined at 40 CFR 2302 shall not be reco�nized as confidential
<br /> information and shall be available to the public without restriction.
<br /> (�� Board o�'Works powers. If any waters or wastes are discharged, or are
<br /> proposed to be discharged, to the public sewers, which waters contain the
<br /> substances or possess the characteristics enumerated in this aArticle, and which in
<br /> the judgment of the Board may have a deleterious effect upon the sewage works,
<br /> processes, equipment or receiving waters, or otherwise create a hazard to life or
<br /> constitute a public nuisance, the Board may do any of the followin�:
<br /> (1) Require new ���tts�es users or ��es users with significant
<br /> increase in discharges to submit information on waste water characteristics
<br /> and obtain prior approval for discharges. For purposes of this requirement,
