COo�{ S—�I <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA,AMENDING CHAPTER 17,ARTICLE 2, DIVISIONS 1,3, 4 AND 6 OF THE <br /> SOUTH BEND MUNICIPAL CODE TO INCORPORATE THE ENVIRONMENTAL <br /> PROTECTION AGENCY(EPA)'S MODEL PRETREATMENT ORDINANCE <br /> STATEMENT OF PURPOSE AND INTENT <br /> The U.S. Environmental Protection Agency (EPA) Office of Wastewater Management <br /> published its most recent Model Pretreatment Ordinance in January 2007. The City of South <br /> Bend's adoption of this Model Ordinance by amending the South Bend Municipal Code at <br /> Chapter 17, Article 2, Divisions 1 and 3 will enable South Bend to comply fully with all <br /> applicable State and Federal laws, including the Clean Water Act (33 United States Code § 1251 <br /> et seq•) and the General Pretreatment Regulations (Title 40, Code of Federal Regulations [CFR] <br /> Part 403. It will further protect South Bend's water treatment processes, and it will enable South <br /> Bend to comply with its National Pollutant Discharge Elimination System (NPDES) permit <br /> conditions, as well as any other State and Federal laws to which a publicly owned wastewater <br /> treatment works is subject. <br /> This ordinance also amends Chapter 17, Article 2, Divisions 4 and 6 to conform to the <br /> amendments of Divisions 1 and 3, and all amendments to the South Bend Municipal Code within <br /> this ordinance are in the best interest of South Bend, its citizens, and its water resources. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND, that Chapter 17, Article 2, Divisions 1, and 3 shall be amended in <br /> their entirety to read as follows: <br /> SECTION I. Chapter 17, Article 2, Division 1, Section 17-5 of the South Bend Municipal Code <br /> shall be amended to read in its entirety as follows: <br /> Sec. 17-5�I����e�s Abbreviations. <br /> � The following abbreviations when used in this Article, shall have the following <br /> desi�nated meaning: <br /> BOD—Biochemical Oxy�en Demand <br /> BMP—Best Management Practice <br /> BMR—Baseline Monitoring Report <br /> CFR—Code of Federal Re�ulations <br /> CIU—Cate�orical Industrial User <br /> COD—Chemical Oxygen Demand <br /> 1 <br />
