REGULAR MEETING APRIL 25,2005 of the annexation in the same manner as the services are provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws; and (6) the plan for hiring the employees of other governmental entities whose jobs will be eliminated by the proposed annexation; and WHEREAS, the Board of Public Works of the City of South Bend, and the Board of Public Safety of the City of South Bend, have each approved the written fiscal plan as amended and established a policy for the provision of services to the territory proposed to be annexed, which plan and policy the Common Council finds to be appropriate and in the best interest of the City, and, which it desires to adopt. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. It is in the best interest of the City of South Bend and the area proposed to be annexed that the following described real property located in German Township, St. Joseph County, Indiana, be annexed to the City of South Bend: A PART OF THE NORTH HALF OF SECTION 17 AND SECTION 18, TOWNSHIP 38 NORTH, RANGE 2 EAST AND A PART OF FRACTIONAL SECTION 7 AND FRACTIONAL SECTION 8, TOWNSHIP 38 NORTH, RANGE 2 EAST, ALL IN GERMAN TOWNSHIP, ST. JOSEPH COUNTY, INDIANA, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF LOT 12 IN CHEROKEE GARDENS SUBDIVISION RECORDED IN PLAT BOOK 16, PAGE C-2, IN THE OFFICE OF RECORDER OF ST. JOSEPH COUNTY; THENCE SOUTH 0 DEGREES 14 MINUTES 27 SECONDS EAST PARALLEL WITH THE EAST LINE OF THE NORTHWEST QUARTER OF SAID SECTION 17, A DISTANCE OF 1370.15 FEET TO THE SOUTHWEST CORNER OF LOT 3 IN CHURCH’S MINOR SUBDIVISION, RECORDED UNDER INSTRUMENT NUMBER 0038244 IN SAID OFFICE OF RECORDER; THENCE NORTH 89 DEGREES 50 MINUTES 53 SECONDS WEST ALONG THE SOUTH LINE OF SAID CHURCH’S MINOR SUBDIVISION, PROJECTED, A DISTANCE OF 20.00 FEET; THENCE SOUTH 0 DEGREES 14 MINUTES 27 SECONDS EAST PARALLEL WITH SAID EAST LINE OF SAID NORTHWEST QUARTER, A DISTANCE OF 531.84 FEET TO A POINT ON THE NORTH LINE OF J. LIGHTNER MINOR SUBDIVISION, RECORDED UNDER INSTRUMENT NUMBER 9620477; THENCE SOUTH 89 DEGREES 52 MINUTES 17 SECONDS EAST ALONG THE NORTH LINE OF SAID J. LIGHTNER MINOR SUBDIVISION, A DISTANCE OF 20.00 FEET TO THE NORTHWEST CORNER OF LOT 1 IN SAID J. LIGHTNER MINOR SUBDIVISION;
