0 RESOLUTION NO. 2680 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT <br />COMMISSION SETTING A PUBLIC HEARING ON THE <br />APPROPRIATION OF MONIES FROM THE REDEVELOPMENT <br />GENERAL FUND (FUND 433) FOR THE PURPOSE OF PAYING <br />FOR CERTAIN EXPENSES INCURRED BY THE <br />REDEVELOPMENT COMMISSION <br />WHEREAS, the Redevelopment General Fund —Fund 433 (the "General Fund ") was <br />established for the purpose of holding, among other things, certain miscellaneous revenue proceeds <br />(the "Proceeds ") received by the South Bend Redevelopment Commission (the "Commission "); and <br />WHEREAS, the Commission desires to engage outside legal counsel to assist the <br />Commission in its redevelopment efforts (the "Services "); and <br />WHEREAS, there are insufficient funds available or provided for in the existing budget and <br />tax levy which may be applied to payment for the Services; and <br />WHEREAS, the Commission desires to pay certain expenses incurred by it out of the <br />Proceeds; and <br />WHEREAS, such appropriations are subject to the provisions of Indiana Code § 6- 1.1 -18 -5; <br />and <br />WHEREAS, on April 23, 2010 the Commission adopted Resolution 2664 appropriating <br />Fifteen Thousand and no /100 Dollars ($15,000.00) for purposes of paying the Services ; and <br />WHEREAS, the Commission desires to set a public hearing for July 9, 2010 at 10:00 a.m. in <br />the Board of Public Works Meeting Room, 13t' Floor, County -City Building, 227 West Jefferson <br />Boulevard, South Bend, Indiana 46601 to amend such appropriation and to authorize the Secretary <br />of the Commission to duly publish notice of said hearing in accordance with Indiana Code § 6 -1.1- <br />18-5 and Indiana Code § 5- 3- 1 -2(b); <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT <br />COMMISSION AS FOLLOWS: <br />1. The Commission hereby finds that there are insufficient funds available or provided <br />for in the existing budget and tax levy which may be applied to the payment of the Services. <br />2. The Commission hereby approves the use of funds in the General Fund in an amount <br />not to exceed an additional Seventy Thousand and 00 /100 Dollars ($70,000.00) for purposes of <br />paying the Services and desires to appropriate the said funds for said purpose. <br />3. The Secretary f the Commission is hereby authorized and directed to take all <br />rY Y <br />necessary steps to obtain the approval of the expenditure of such funds and to appropriate such funds <br />pursuant to Indiana Code § 6 -1.1 -18.5, including publication in accordance with Indiana Code §5 -3 -1 <br />
