REGULAR MEETING MAY 22, 2006 <br />Councilmember White explained the procedures to be followed for tonight’s meeting in <br />accordance with Article 1, Section 2-11 of the South Bend Municipal Code and that pamphlets <br />were available to the pubic, which outline the Council rules and procedures, and are located on <br />the railing in the Council Chambers. <br />PUBLIC HEARINGS <br />BILL NO. 28-06 PUBLIC HEARING ON A BILL OF THE <br /> COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA AMENDING ARTICLE 18, OF <br /> CHAPTER 2 OF THE SOUTH BEND <br /> MUNICIPAL CODE TO SET AND ADJUST <br /> FEES FOR DOCUMENTS AND SERVICES <br />Councilmember Varner made a motion to hear the substitute version of this bill. Councilmember <br />Dieter seconded the motion which carried by a voice vote of eight (8) ayes. <br />Councilmember Pfeifer, Chairperson, Personnel & Finance Committee, reported that this <br />committee met on this bill this afternoon and voted to send it to the full Council with a favorable <br />recommendation. <br />th <br />Mr. Thomas Bodnar, Assistant City Attorney, 14 Floor County-City Building, made the <br />presentation for this bill. <br />Mr. Bodnar advised that this bill is an amendment to Chapter 2, Article 18 of the South Bend <br />Municipal Code to Set and Adjust Fees for Documents and Services. The substitute version of <br />this bill amends items 10, 13 and 21. In item 10 there is now a provision for a $2.00 service fee <br />plus outside costs if the City must use outside resources to reproduce the videotapes. The Police <br />Department will continue to process its videotapes when requested. However, the Department of <br />Code Enforcement does not have the equipment to make their own videotapes to del with the <br />infrequent requests. Mr. Bodnar stated that in Item 13 that IC 16-39-9-3 calls for a $15.00 <br />minimum fee for producing EMS Reports. The substantial amount of time expended in <br />connection with an EMS Report justifies the $15.00 fee. The one new item is item 21, a <br />processing fee to be paid to the Police Department prior to the release of a tow. This fee will <br />apply only in cases in which the Police Department initiates the tow, not those performed by <br />Code Enforcement. It will not be imposed in those cases in which the car owner selects his own <br />tow company after an accident. The amount does not reflect time at the scene, but the <br />reimbursement for the cost of work done at the front desk, by the Police Department inspecting <br />the storage lots, and in the communications center. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill, Councilmember Kelly made a motion for favorable recommendation to full Council <br />concerning this bill as substituted.
