REGULAR MEETING APRIL 25 2011 146 WHEREAS, the Department, through the Commission, desires to transfer the Property to the City and to authorize the staff of the Department to approve and execute quitclaim deeds effecting the transfer of the Property; and WHEREAS, The Commission has adopted a resolution consistent with the requirement of Indiana § 36---1-11-8; and NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND BOARD OF PUBLIC WORKS AS FOLLOWS: 1. The transfer of the Property described at Exhibit A situated in St. Joseph County, Indiana, by the South Bend Redevelopment Commission, to the Board of Public Works, for and on behalf of the City of South Bend shall be, and hereby is, accepted and approved. 2. The staff of the City of South Bend, Department of Public Works shall be, and hereby are, authorized to accept the executed quit-claim deeds and present them for recording by the Office of the Recorder of St. Joseph County, Indiana. 2. This Resolution shall be in full force and effect upon its adoption. CITY OF SOUTH BEND BOARD OF PUBLIC WORKS sl Gary Gilot sl Donald Inks s/ Carl Littrell ATTEST: ............ s/Linda Martin, Clerk ADOPT RESOLUTION NO. 34-2011 — DECLARING ITS INTENT TO REIMBURSE EXPENDITURES RELATED TO THE DEVELOPMENT AND CONSTRUCTION OF A FIRE TRAINING CENTER WITH DEBT FINANCING DRAWN BY THE CITY OF SOUTH BEND, INDIANA Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the following Resolution was adopted by the Board of Public Works subject to attaching the project description: RESOLUTION NO. 34-2011 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND DECLARING ITS INTENT TO REIMBURSE EXPENDITURES RELATED TO DEVELOPMENT AND CONSTRUCTION OF A FIRE TRAINING CENTER WITH DEBT FINANCING DRAWN BY THE CITY OF SOUTH BEND, INDIANA WHEREAS, the City of South Bend Board of Public Works ("Board") is the contracting body of the Civil City of South Bend, Indiana ("City") and exists and operates under the provisions of I.C. 36-9-6, et seq., as amended from time to time ("Act"); and - WHEREAS, the City, acting by and through its Board of Public Works intends to develop and construct a Fire Training Center ("Project"), and further intends to finance the Project by way of a mortgage instrument evidencing its debt obligation; and WHEREAS, the Board reasonably expects that the City will reimburse preliminary costs incurred in the Project through the mortgage to be entered into by the City for the purpose of financing the Project; and
