REGULAR MEETING APRIL 10, 2006 <br />Ms. Judith Overmyer, Program Organizer and sponsor, thanked the Council for this <br />honor. Ms. Overmyer stated that this team is truly a hard working dedicated group of <br />individuals. She stated that they are excellent role models for all students. She hopes to <br />bring home a victory when the “Legal Eagles” represent the State of Indiana at the <br />National High School Mock Trial Championship in Oklahoma City, Oklahoma in May. <br />Councilmembers Puzzello, Kelly and Dieter offered comments and congratulated and <br />wish the team well at the National Competition. <br />Councilmember Kirsits made a motion to adopt this Resolution by acclamation. <br />Councilmember White seconded the motion which carried. <br />RESOLUTION NO. 3574-06 A RESOLUTION OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, <br /> SUPPORTING THE OVERALL INTENT OF THE <br /> ST. JOSEPH COUNTY ORDINANCE WHICH <br /> BANS SMOKING IN SPECIFIC PLACES WITH <br /> THE COUNCIL ENCOURAGING ALL PERSON <br />TH <br /> TO EAT OUT ON MONDAY, APRIL 10 AS A <br /> SHOW OF SUPPORT OF SMOKE-FREE <br /> ENVIRONMENT IN RESTAURANT <br /> THROUGHOUT OUR COMMUNITY <br />Whereas, the Common Council of the City of South Bend, Indiana, recognizes <br />that the St. Joseph County Council passed Bill No. 83-05 on February 14, 2006 by a 7-2 <br />vote, with these regulations becoming effective on April 10, 2006; and <br />Whereas, the Common Council notes in that county ordinance the National <br />Cancer Institute was quoted as having determined that secondhand smoke is responsible <br />for the early deaths of approximately 65,000 Americans each year; that secondhand <br />smoke is particularly hazardous to the elderly, people with cardiovascular disease, <br />impaired respiratory functions., asthmatics and children; and that the U.S. Surgeon <br />General has determined that the separation of smokers and nonsmokers within the same <br />air space may reduce but does not eliminate the exposure of nonsmokers to secondhand <br />smoke; and <br />Whereas, the Council notes that during the two (2) public meetings held by the <br />St. Joseph County Council, with the first public hearing lasting over four (4) hours, there <br />was much public debate with several business owners, and restaurant owners in <br />particular, expressing concern that such a smoking ban would put them out of business; <br />and <br />Whereas, many positive initiatives are being carried out throughout St. Joseph <br />County as a show of support to businesses affected by the St. Joseph County Clean Air <br />Ordinance with one of them being the initiative of the Leadership South <br />Bend/Mishawaka Class 32 Health Project Team supported by Town Air-Freight called <br />“Take your family out to dinner” set for Monday, April 10, 2006”. <br />Now, Therefore, be it resolved, by the Common Council of South Bend, Indiana, <br />as follows: <br />Section I. On behalf of all of the citizens of the City of South Bend, Indiana, the <br />Common Council publicly supports the overall intent of the St. Joseph County Clean Air <br />Ordinance. <br />Section II. As a show of support of cleaner air throughout our community, the South <br />Take your family out to <br />Bend Common Council urges families to participate in the “ <br />dinner initiative on Monday, April 10, 2006 <br />”; and further encourages everyone to <br />support restaurants operating throughout St. Joseph County thereafter, as we positively <br />move forward in working toward a healthier community for all. <br />2 <br /> <br />
