Bill No. 11-23—Special Exception—304 W. Garst <br /> Bill No. 12-11 <br /> This bill would ask a property.64 acres in size be added to an annexation bill passed by the <br /> Council in 2005. Chairperson Kirsits asked Mike Divita from the Economic Development <br /> Department staff to explain the requested action. Divita explained that this voluntary annexation <br /> by Fiskar's was to correct a discrepancy in the 2005 bill which inadvertently included the parcel at <br /> that time. Jim Agens from Fiskars was present to represent the company. Karen White's <br /> questions concerning the legality of the original action were allayed by Council Attorney Kathleen <br /> Cekanski-Farrand who said the request was both expeditious and appropriate. Hearing that <br /> Councilmember Varner moved the bill go to the Council favorably. Councilmember Oliver Davis <br /> seconded and all affirmed. <br /> 8ill No. 11-23 � <br /> Mark Lyons from the Building Department made the initial presentation to the Council. <br /> Recounting the hearing before the BZA, Mark reported the bill received a unanimous favorable <br /> recommendation. The bill would allow an additional tower for the Charles Hayes Co. of 240 feet <br /> in height for telecommunications to supplement a 349 foot tower already on the property. <br /> Representing the company was Kerry Wallace. Gary Gilot spoke in support of the request. On a <br /> motion to send favorably by Councilmember Oliver Davis and seconded by David Varner, Kirsits <br /> asked for a vote. All affirmed. <br /> • Miscellaneous: <br /> Councilmember Henry Davis asked about pending Bill NO. 10-11 which awaits a hearing before <br /> the Area Plan Commission on April 19. He was under the impression the bill was schedufed to <br /> be discussed at this meeting. In that this bill which would allow"backyard chickens"within the <br /> city limits is bound to need much more research and discussion. Councilmember Kirsits said he <br /> would poll the full Council for support or opposition to the bill. Only if a majority of the Council <br /> was in favor would Council Attorney Kathleen Cekanski-Farrand be asked to do research. <br />
