Substitute Bill No. 86-10 <br /> Apri14,2011 <br /> Page 5 <br /> (v) Supplier or distributor means any business entity supplying materials,but no <br /> significant on-site labor is contributed in furtherance of the contract or to a vendor.�'` <br /> (w) Vendor means any person or business entity that has entered into a binding contract for <br /> the provision of materials or services.13 <br /> (x) Women Business Enterprise hereinafter referred to as (WBE)means-any women- <br /> owned business which has been certified under the requirements of this chapter: <br /> (1) Which is at least fifty-one percent (51%) owned by persons whose gender is <br /> female, or in the case of any publicly owned business, at least fifty-one percent (51) <br /> of the stock is owned by persons whose gender is female; and <br /> (2) Whose management and daily business operations are controlled by persons <br /> whose gender is female and who own it and have an interest in capital, assets, and <br /> profits and losses of the business proportionate to the percentage of ownership. <br /> SECTION IL Article 2 of Chapter 14.5 of the Soutli Bend Mu�zicipal Code is amended to � <br /> read in its entirety as follows: <br /> ARTICLE 2. Promoting Minority Business Enterprise and Women Business <br /> Enterprise Utilization. <br /> Sec. 14.5-3. MBE/WBE Utilization Board - Membersliip, Powers & Duties, Roles of City <br /> Departments for Implementation. <br /> (a) Nine-Member Board: There is created a City MBE/WBE Utilization Board. The Board <br /> shall consist of nine (9) members. Three (3) members shall be appointed by the Common Council, <br /> three (3) members shall be appointed by the Mayor, one (1) member shall be appointed by the <br /> local chamber of commerce, one (1) resident of the City who is appointed by the Council in <br /> consultation with the Mayor, and the Director of Public Works or his/her designee. <br /> (b) Term of Appointments: All Board appointments expire on December 31 st of the second <br /> year for which they are made. Board members may be removed at the pleasure of the appointing <br /> authority prior to the expiration of their terms. <br /> (c) Board Officers: The Board shall elect from its membership a President and a Vice- <br /> President, wllo shall act as the presiding officer in the absence of the President. The Board shall also <br /> elect from its membership a Secretary, who shall provide notice and maintain minutes of Board <br /> meetings as required under the Indiana Open Door Law. <br /> �� 251ndia�ia Adrninish•ative Code 5-2-1 (a)(20) sets forth this definition for"subcontractor". <br /> ��25 bzdiana Administratii�e Code 5-2-1 (a)(21) sets forth this definition for"supplier or distributor". <br /> 13 25 Indiana Adnzinisti-ative Code 5-2-1 (a)(22) sets forth a similar definition for"vendor". <br />
