REGULAR MEETING FEBRUARY. 28, 2011 62 <br /> s/Donald Inks <br /> s/ Carl Littrell <br /> ATTEST: <br /> s/Linda Martin, Cleric <br /> ADOPT RESOLUTION NO. 20-2011 — A RESOLUTION OF THE BOARD OF PUBLIC <br /> WORKS OF THE CITY OF SOUTH BEND, INDIANA AUTHORIZING THE TRANSFER <br /> OF REAL PROPERTY TO NORTHEAST NEIGHBORHOOD REVITALIZATION <br /> ORGANIZATION, INC. <br /> Upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, the following Resolution <br /> was adopted by the Board of Public Works: <br /> RESOLUTION NO. 20-2011 <br /> A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br /> OF THE CITY OF SOUTH BEND, INDIANA <br /> AUTHORIZING THE TRANSFER OF REAL PROPERTY TO <br /> NORTHEAST NEIGHBORHOOD REVITALIZATION <br /> ORGANIZATION, INC. <br /> WHEREAS, the City of South Bend, Indiana, Board of Public Works (the "Board") has <br /> custody of and may maintain and dispose of all real property owned by the City of South Bend, <br /> Indiana(the "City")pursuant to I.C. 36-9-6-3; and <br /> WHEREAS, the Northeast Neighborhood Revitalization Organization, Inc. (the <br /> "NNRO") is an Indiana nonprofit entity organized for educational, literary, scientific, religious <br /> or charitable purposes that is exempt from federal income taxation under Section 501 of the <br /> Internal Revenue Code; and <br /> WHEREAS, the City is the owner of the following described real property situated in St. <br /> Joseph County, Indiana: <br /> 1313 Bissell, as more particularly described in EXHIBIT A <br /> 917 Hill, as more particularly described in EXHIBIT B <br /> (collectively referred to as the "Real Property"); and <br /> WHEREAS, the Real Property is either vacant land or has residential structures located <br /> on the parcel; and <br /> WHEREAS, pursuant to I.C. 36-1-11-1(b) (7), the City may transfer property, without <br /> consideration, to an Indiana nonprofit entity organized for educational, literary, scientific, <br /> religious or charitable purposes that is exempt from federal income taxation under Section 501 of <br /> the Internal Revenue Code; and <br /> WHEREAS, the City, acting by and through the Board, hereby expresses its desire to <br /> transfer the Real Property to the NNRO; and <br /> WHEREAS, the NNRO is willing to accept the transfer of the Real Property from the <br /> City for the purpose of constructing or rehabilitating residential structures on the Real Property <br /> and disposing of the Real Property pursuant to I.C. 3 6-1-11-1(b) (7) following construction or <br /> rehabilitation. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS <br /> OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: <br /> 1. The transfer of the following described real property situated in St. Joseph <br /> County, Indiana: <br /> 1313 Bissell, as more particularly described in EXHIBITA <br /> 917 Hill, as more particularly described in EXHIBIT B <br />
