REGULAR MEETING FEBRUARY. 28, 2011 62 s/Donald Inks s/ Carl Littrell ATTEST: s/Linda Martin, Cleric ADOPT RESOLUTION NO. 20-2011 — A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA AUTHORIZING THE TRANSFER OF REAL PROPERTY TO NORTHEAST NEIGHBORHOOD REVITALIZATION ORGANIZATION, INC. Upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, the following Resolution was adopted by the Board of Public Works: RESOLUTION NO. 20-2011 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA AUTHORIZING THE TRANSFER OF REAL PROPERTY TO NORTHEAST NEIGHBORHOOD REVITALIZATION ORGANIZATION, INC. WHEREAS, the City of South Bend, Indiana, Board of Public Works (the "Board") has custody of and may maintain and dispose of all real property owned by the City of South Bend, Indiana(the "City")pursuant to I.C. 36-9-6-3; and WHEREAS, the Northeast Neighborhood Revitalization Organization, Inc. (the "NNRO") is an Indiana nonprofit entity organized for educational, literary, scientific, religious or charitable purposes that is exempt from federal income taxation under Section 501 of the Internal Revenue Code; and WHEREAS, the City is the owner of the following described real property situated in St. Joseph County, Indiana: 1313 Bissell, as more particularly described in EXHIBIT A 917 Hill, as more particularly described in EXHIBIT B (collectively referred to as the "Real Property"); and WHEREAS, the Real Property is either vacant land or has residential structures located on the parcel; and WHEREAS, pursuant to I.C. 36-1-11-1(b) (7), the City may transfer property, without consideration, to an Indiana nonprofit entity organized for educational, literary, scientific, religious or charitable purposes that is exempt from federal income taxation under Section 501 of the Internal Revenue Code; and WHEREAS, the City, acting by and through the Board, hereby expresses its desire to transfer the Real Property to the NNRO; and WHEREAS, the NNRO is willing to accept the transfer of the Real Property from the City for the purpose of constructing or rehabilitating residential structures on the Real Property and disposing of the Real Property pursuant to I.C. 3 6-1-11-1(b) (7) following construction or rehabilitation. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: 1. The transfer of the following described real property situated in St. Joseph County, Indiana: 1313 Bissell, as more particularly described in EXHIBITA 917 Hill, as more particularly described in EXHIBIT B
