So much of such 'cost as shall be equivalent to the construction of an ade- <br />quate local sewer not adapted to:receive sewage from collateral drains or sewers-; <br />if guilt along the proposed line as hereinabove set forth, shall be paid by the. <br />abutting property holders and the City of Soutii Bend, if it be determined that said <br />City, is .benefitted by said sewer in the same manner and to the same extent as local <br />sewers, are paid for by them under the Statutes in such cases made and provided. <br />20 The excess of cast over and above W11€tt would be equivalent to the -host of a <br />local sewer, if built along said line, shall be assessed against each piece of <br />property in the. dittriet or area to be drained and against the City, if it be deter- <br />mined that the said City iO benef'itted by the said sewer, according to the ma,ru er <br />and method prescribed by law, all of the property be-ieficially affected lies within <br />the f011oving described territ-ory in the City of South Bend, County�of St. Joseph <br />and State of Indiana, to-vTit:- <br />Beginning on the south line of La Salle Avenue anri the, <br />first alley west of Michigan. St.thenee ' south along said alley and said alley pro- <br />duced to a point one hundred and fifty (1501) feet north of the north line of Ewing. <br />Avenue;thenee east to a paint one hundred (100t) feet west of the west line of <br />chi an Street; thence south parallel with and one hundred (loot) feet west of the <br />west line of said Michigan Street to the north line of Ewing Avenue; thence east <br />along the north line of Ewing Avenue to a point one hundred (1001) feet east of the <br />east line.of Michigan Street; thence north parallel with andone hundred,(1QOt feet <br />east of the east line of Mic,�igan Street to a point forty two and 3 (42.66' feet <br />noth of the north line of :Don-_ld Street; thence. east to the first ally east of <br />Michigan Street; thence north along the first alley east of Michigan Street to the <br />first alley soh of Calvert Street; thence east along the first alley south of <br />Calvert Street to St. Joseph Street;• thence north clang St. Joseph Street .to the <br />first alley south of Dubail Avenue; thence eastalongthe first alley aouth,of <br />Dubail Avenue to Carroll Street; thence north along Carroll Street to the first <br />alley south of Pennsylvania Avenue; thence west 819ong the first alley south of <br />Pennsylvania Ave. to .St. Joseph Street; thence north along. Pennsylvania Avenue to the first alley west of Carroll Street; thence north along <br />the first alley west of Carroll Street and said alley produced to a point one <br />hundred and fifty (150t) feet south of the south line of Sample Street; thence <br />west parallel with and one hundred and fifty (1501) feet south of the south Iiiie of - <br />Sample Street to a point one hundred and sixty five (165') feet east of the east line <br />of Michigan Street; thence .north parallel with and one hundred anal. sixty five (1651 ) <br />feet east of the east line of Michigan Street to a point one hundred and fifty (1501) <br />feet south of the south line of . Tutt Street, thence east parallel with and one <br />hundred and fifty (150') feet .south of - the south line, of Tutt -Street to the south- <br />erly line o.f the Lake. Shore and. Michigan Southern Railway company's -right-of-way; <br />thence north across lot twenty nine (29) Denniston's & Fellows addition to the north <br />and sofh alley between Columbia Street and Fellows Street; .thence still nottkh <br />following the said alley and said alley prduced to Monroe Street; thence - east along <br />Monroe Street tD a point one hundred (1001) feet east of the east line of Columbia <br />Street; thence north parallel with and one hundred (loot) feet east of the east <br />line of Columbia Street to Division Street; thence east along Division Street to <br />Vistula Avenue; thence. northwesterly following said Vistula Avenue. to a point <br />Sixty six (661) feet north of the north line of .Jefferson Boulevard; thence west <br />parallel with and si xty six (66t) feet north of the north line of Jefferson Bouievad <br />to first alley east of Michigan Street; thence north along the first alley east <br />of Michigan Street. and Dill Street to Colfax Avenue; thence west on Colfax Ave. <br />to a point one hundred (100t) feet east of the east lime of Michigan Street; thence^ <br />north parallel with and one hundred (1001) feet east of the east lineof Michigan <br />Street to the south line of La Salle Avenue; thence west along the south line of <br />La Salle Avenue. to the first alley west of Michigan Street Mich point is the place <br />of beginning. <br />Said Improvement shall be knowe, as MICHIQA:3 STREET TRUNK SEWER <br />under Improvement Resolution No. 367, in the City of South Bend, Indiana. <br />And each piece of property in said district or, area above described <br />'includ.in g abutting property holders and the said City of South Bend, if the ' said <br />City is benefitted, shall be assessed, as aforesaid, to pay said excess of cost over <br />and above what would be equivalent to the cost of a local sewer; all. of w ich will <br />more fully ap pear by reference to the profiles, map, dravdngs and specifications <br />now on file in the office of the Department of Public works of said City, vhich,among <br />
