50 <br />.Assessments, if deferred, are to be paid in ten equal annual installments, with in- <br />terest at the rate of Six per cent per annum. A bond or bonds shall be issued to the <br />contractor in payment for such work, unless the property owners pay said assessments <br />before said Bond or ponds are issued. Under no circumstances shall the City of South <br />Bend be or be held responsible for any sum or sums due -from said property owner or <br />owners for said work, or for the collection of same, or for the payment of any bond or <br />bondsm certificate or eertii'ieates, iisued to said contractor in payr-ent for such <br />work, except for suci moneys as shall have been actually received by the City from the <br />assessments for such impro,verient, or such moneys as said City is by said above en- <br />titled Act required to pay.. Notice os this resolution shall be published on the 26th. day of <br />Septenher,1914 and on the 3rd. aay Of October,l1=',1_4. in the South Bend Daily Tribune <br />This Board will give a hearing on this resolution at its office in the City Hall <br />on the 20th., day of October,1914. at 7 *45 P.M. <br />Adopted this 22nd. day of Septeriber.,1914. <br />BOARD Or PUBLIC WORKS. <br />The City Engineer submitted the list of property owners in the ma r of <br />fthe appropriation of certain property under Condemnation Resolution No. 30, as per <br />resolution for Condemnation on Page 351 Record 5, which list includes the names of <br />the owners and holders of property and of interests therein sought to be taken or <br />beneficially or injuriously affected, and the description of the serveral pieces of <br />property which is -affected by the said appropriation proceedings. <br />Thereupon the Board proceeded to award the damages sustained and to <br />assess the benefits accruing to each piece of property upon said list. <br />It was thereupon, upon motion duly made and seconded and unanimously <br />adopted, resolved that said list, together with the amounts of benefits and damages <br />and net benefits and net damages therein set ,forth as to the servera-1 parcels of land <br />be adopted and the respective amount of benefits contained in said list be and are <br />hereby assessed against the serveral tracts of land as specifically set forth in said <br />list, and that the respective amounts of damages contained in the said list be and <br />are hereby awarded to the serveral tracts of land as specifically set forth in said <br />list, and that the net benefits or net damages, as the ease may be as to the respectie <br />tracts of land, contained in said list are hereby awarded or assessed, as the case <br />may be as to the several tracts of land. <br />The Board hereby further sets off the benefits and damages each against <br />the other where both benefits and damages are assessed against the same piece of pro- <br />perty, tract of land or interest , and hereby fixes said respective net benefits <br />as the amount that shall be paid by the respective owners as benefits, and further <br />hereby fixes the respective net damages as to the several tracts as the amount that <br />shall be paid to the owners of the respective tracts as damages. <br />Thereupon, upon motion duly made and seconded and unanimously adopted, <br />the 24th. day of November,1914 at 7:45 P.M. was fixed as the day on which this <br />Board will receive or hear remonstrances from persons with regard to the amount of <br />their respective awards or assessments, and the Clerk of this Board was instructed <br />to prepare and cause to be duly and legally given, notices to the Owners of each <br />parcel of property, showing the amount of the assessment or award, with a descrip- <br />tion of the property affected, and the date of said hearing. <br />President. <br />
