494 Tuesday Septemberl5th.11914. Continued. J LO-CZ SEWER IMPROVEMENT RESOLUTT0N NO. 360. Resolved by the Board of Public lfforks of the City of South Bend,County of St. Joseph, State of Indiana. That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon, and not intended or adapted for receiving sewerage From collateral drainsbe and the same is, hereby ordered. in and along Nineteenth Street in the City -of South Bend( Being Logan -Street in t.1-e City of Mishawaka, Ind.) frnm the St. Joseph River to Mishawaka Avenue. viz: - Beginning at North end of the Logan Street Bridge, thence north along the center line of Nineteenth St. to the center of Vine Street with a 15 " vitrified pipe sewer, thence still north along the center of said Nineteenth Street with a 12 " vitrified pipe sewer to the center of Mishawaka Ave. together with the necessary manholes, inlets, flush tanks and house connections to the curb line along the line 0 of said improvement. And such improvement is now ordered. NOTE: - Nineteenth Street in City of in the City of Mishawaka, Indiana, and is South Bend, Ind. is known as Logan Street the dividing line betwee--i the two Cities. And said sewer, withall its appurtenances shall be consructed in accordance with the profile and specifications now on file in tiie office of the Department of Public Works of said City. The cost of said improvement shall be apportioned against and paid by the property holders whose property abuts thereon, and upon the C°ty of South Bend if the City is benefitted by said improvement, all according to the method and mariner pro ided for in Act of the General Assembly of the State of Indiana,. entitled "An Act Concerning Municipal Corporat ions," approved March 6,1905. Apsessrients, i4' deferred, are to be paid in ten equal annual installmmbtis, with in- terest et the rate of Six per cent per annum. A bond or bo is shal-1 be issued to the ^ontractor in payment for uch work, unless the property owners pay said asse- s- ments before said bond or bonds are is.,ued. Under no circumstances shall the City of South Bend be or ne held responsible for any sum or sums due f^om said property owner or oinmers for said work, or for he collection of s-=e or ror the payment of any bond or bonds, certificate or certificates, issued to said contractor in payment for such work, except f'or such moneys as shall have been actua ly received by the City from the assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All proeeeeings had, and work done in the making of said improvement, assessment df property, collections of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act. Notice os this resolution shall be published on the l9th., day of September,1914 and on the 25th. day of September,1914 in the South Bend Daily News - Times, This Board will give a hearing on this resolution at its office in the City Hall on the 13th. day of October91914 at 7:45 P.M.
