D. Williams, President and CEO Executive Director of Family&Children's Center Properties Management, Inc. and Ann E. Kolata, Deputy Executive Director of the South Bend Redevelopment Commission, make application and petition the Common Council of the City of South Bend, Indiana to amend the zoning ordinance as herein requested. 1) The property sought to be rezoned is located at: On Fellows Street at the intersection with vacated Keasey Street as shown on the attached E�ibit "A", consisting of two parcels, Parcel "B" being owned by Family & Children's Center Properties Management, Inc. and Parcel "C" being owned by South Bend Redevelopment Commission. 2) The name and Address of the Property owner is: Family & Children's Center Properties Management, Inc., 1411 Lincolnway West, Mishawaka, Indiana 46544, as to the northerly portion of the property described as Parcel "B" on Exhibit "A" attached hereto and The South Bend Redevelopment Commission, 12th Floor, County-City Building, South Bend, Indiana 46601, as to the southerly portion of the property described as Pazcel "C" on E�chibit "A" attached hereto. 3) It is desired and requested that the Property be rezoned from "B" Residential District "A" Height and Area to "PHC Professional/Health Care District". 4) The property will be purchased by Memorial Health System, Inc. which will build a medical clinic containing approximately Sixteen Thousand Square Feet (16,000 sq. ft.) of space on the property as is depicted in the preliminary site plan which is filed with this Petition. 5) Attached is a copy of (a) legal description of the property; (b) a list of names and addresses of all property owners within 300 feet of the petitioned Property (c) six (6) site plans; and addressed, stamped envelopes for all property owners within 300 feet of the subject property. 6) By signing this Petition, I and any contingent purchaser understand that if the Council approves this petition to rezone, it may be approved subject to the submittal of a final site plan. A final site plan must be submitted to the Area Plan Commission within one(1)year of the Council's action. Failure to submit a final site plan within that time period, causes the zoning of the petitioned property to revert to the initial zoning classification.
