• <br />A part of the Southwest Quarter of the Southwest Quarter of Section 17, Township 38 North, <br />Range 2 East, described as beginning 220 feet East of the Southwest corner of said Southwest <br />Quarter; thence North 200 feet; thence East 110 feet; thence South 200 feet; thence West 110 <br />feet to the place of beginning, <br />And also including the following: Part of the Southwest Quarter (1/4) of the Southwest Quarter <br />(1/4) of Section Seventeen (17), Township Thirty -eight (38) North, Range Two (2) East, St. <br />Joseph County, Indiana, described as follows: Commencing at the Southwest corner of said <br />Section 17; running thence East along the South line of said Section a distance of 390 feet for <br />the beginning point of this description; thence North 205 feet along the East line of a reserved <br />street to an iron; thence East 138 feet to an iron; thence South 205 feet to a point 138 feet East <br />of the place of beginning; thence West 138 feet to the place of beginning, being Lot Numbered <br />Two (2) in a Minor Subdivision of Lynn Daugherty, recorded June 10, 1966 in the Office of the <br />Recorder of St. Joseph County, Indiana, in Plat Book 22, page "D ", and a piece of land 5 feet <br />North and South lying North of the entire North line of said Lot Numbered Two (2). <br />WHEREAS, Section 43 of the Act permits the creation of an allocation area within an <br />economic development area to provide for the allocation and distribution, as provided by the Act, of <br />the proceeds of taxes levied on property situated in the allocation area; and <br />WHEREAS, the Commission in accordance with the Act, has previously established the <br />Airport Economic Development Area, Allocation Area No. 1 ( "Allocation Area No. 1 "); and <br />WHEREAS, the Commission, in accordance with the Act, expanded the boundaries of the <br />Airport Economic Development Area, Allocation Area No. 1 to include Expansion Area No. 1 and <br />Expansion Area No. 2 by'the adoption of Resolution No. 965, adopted on November 9, 1990, and <br />confirmed by Resolution No 971, adopted on January 2, 1991, and Expansion Area No. 3 by the <br />adoption of Resolution No. 1058, adopted on May 22, 1992, and Expansion Area No. 4 by the <br />adoption of Resolution No. 1349, adopted on July 7, 1995, and Expansion Area No. 5 by the <br />adoption of Resolution No. 1545, adopted on November, 21 1997, and Expansion Areas No. 6,7 <br />and 8 by the adoption of Resolution No. 1667, adopted on February 19, 1999, and Expansion Areas <br />No. 9 and 10 by the adoption of Resolution 1796, adopted on October 20, 2000, and Expansion <br />Area No. 11 by the adoption of Resolution 1827, adopted on February 16, 2001, and Expansion <br />Areas No. 12, 13, 14 and 15 by the adoption of Resolution 1916, adopted on November 1, 2002, <br />and Expansion Area No. 16 by the adoption of Resolution 1977, adopted on July 18, 2003, and <br />Expansion Area No. 17 by the adoption of Resolution 2006, adopted on November 7, 2003, and <br />Expansion Area No. 18 by the adoption of Resolution 2019, adopted on December 19, 2003 and <br />Expansion Area No. 19 by the adoption of Resolution 2090, adopted on October 22, 2004 referred <br />to the Allocation Area, as expanded, as Airport Economic Development Area Allocation Area No. 1, <br />( "Airport Economic Development Area Allocation Area No. V); and <br />WHEREAS, the Commission now desires to expand the boundaries of the Airport Economic <br />Development Area, Allocation Area No. 1 to include the area in Expansion Area No. 20 and this <br />expanded allocation area, comprising Allocation Area No. 1 and Expansion Area No. 20, is <br />hereinafter referred to as the "Allocation Area "; and <br />WHEREAS, the Development Plan includes a list of the parcels of property within the Area to <br />be acquired; and <br />3 <br />
