RESOLUTION NO. X233 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION APPROVING AND AUTHORIZING THE TRANSFER OF PROPERTY TO THE ST. JOSEPH COUNTY AIRPORT AUTHORITY WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend Redevelopment Commission ( "Commission ") is the governing body of the City of South Bend, Department of Redevelopment ( "Department ") and in accordance with I.C. 36 -7 -14 -12.2, the Commission may dispose ofproperty owned by the Department; and WHEREAS, the St. Joseph County Airport Authority ( "Airport Authority ") exists and operates under the provisions of Indiana Code § 8 -22 -3 et seq., as amended from time to time, and pursuant to Indiana Code § 8- 22 -3 -35, the Airport Authority is authorized to purchase and sell real property; and WHEREAS, the Department is the owner of certain real property situated within the City of South Bend, St. Joseph County, Indiana and more particularly described at Exhibit "A" attached hereto and incorporated herein ( "Property "); and WHEREAS, the Commission desires to transfer the Property to the Airport Authority in consideration of the sum of Ten and 00 /100 Dollars ($10.00) in order to facilitate the development of the Airport Economic Development Area and the Airport Authority desires to accept transfer of the Property from the Commission under such terms; and WHEREAS, pursuant to I.C. 36- 1 -11 -8, the Commission and the Airport Authority may exchange or transfer property with one another upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION THAT: 1. The South Bend Redevelopment Commission hereby approves and accepts the transfer of the Property to the St. Joseph County Airport Authority for the sum of Ten and 00 /100 Dollars ($10.00). 2. The South Bend Redevelopment Commission hereby directs its attorney to prepare all documents necessary to carry out the intent expressed herein.
