Mayor Montgomery a.nd City Attorney 'Rom g <br />• <br />were also present. <br />Chief of Police James J.' Hatt reported that Richard O'Hara had b­efi' loeated <br />at Marion Indiana, and -that a subpoena had been•sent.to the 'Max -ion Police` <br />Sl� Chief Hatt futther stated that the subpoena had <br />been served on 0.'Hara; <br />and returned to him (Chief Hate) <br />O:' Hara however failed to appear. <br />Attorney. Dudley M. Shively appeared as a witness in responce to a.sub <br />,.'poena and after being sworn by President Lngeldrum was questioned: <br />by Mayor Montgomery and City Attorney Romig. <br />Mr Sh evely testified that he represented Richard O'Hara in Federal <br />court on. December 23rd., 1927 at. which time he...was arrange on archa :rge <br />Y of p.ossession of intoxicating liquor. :_ <br />-STpon questioning Mr. Shively testified that Richard O'Hara had never' <br />mentioned the; :names of`any City or' County Officials in Federal Court' <br />or gave any testimony that would,reflect in any way on city or`County <br />Ofi:'ca.ls employees or Police Officers. <br />7;. Mr* Shively testified that as near as he could remem= <br />ber,;the only statement that - Richard O'Hara made in referedee to pro= <br />teotion . was, when he related :.# ­how when he'.was rideing. with 'Michael <br />= Sarous proprietor of the Greek Coffee Shop, at 512 -'S. Mich 8t., and <br />when they were in,the vicinity of.Lincoln•Way East and Sample St. <br />Michael Sarous pointed :to a business plaice of soTne .sort and remarked <br />71 _ '` there is a`pla.ce that even the Federal Men wont bother " and again <br />ewhen Sarous came to an inn which Mr. Shively_beleived was supposed <br />to be some where East.of the City,and at the time - operated by O'Hara` <br />and asked Qlhara..for a sum of money which he claimed to have wanted <br />for protection.money -and according, to O'Ha.ra's testimony was to be-paid <br />. to some -attorney,.'but-,when ' questioned in Federal Court as to-the name <br />4_ of'the attorney he could not remember if' Sarous had named the attorney, <br />j` but he ,beleiyed than had not. <br />-: <br />I ahael S"afious the - propr.i•etor of the Greek Coffes Shop at 51.22 . S. _Mich <br />..: of this City who had been subpoened was sworn by President Engel- <br />drum <br />and was questioned by Mayor Montgomery,and City.Attorney Romig: <br />F Michael Sarous denied that he .had ever ,pointed out- <br />a- glace of business on Lindoln'Way East to Richard O'Hara and said <br />"thing abu-tt that particular place or any other place having protection <br />Sarous stoutly denied that -he- had ever. said anything <br />to Hara or any other person about.having protection and asked Mayor <br />�fon- gomery -if it would appear that he had protection when his Coffee <br />shop at -512Q S. Mich St. had been raided five times on gambling warrezt -s <br /><3 ".since January 1st. 1926 -and himself arrested -each time, nad that on four <br />F� - otk�er occasions the police had entered hi s- &toffee Shoe and drove <br />e eryone. out of the place while previous to January 1 1926. -for .a <br />period off' Z ears; he has. been ,raided but, ones..
