over real and personal property, and is covered by a non -reverting insurance premium <br />and liability reserve fund created by the City of South Bend, Ordinance #6657-79, <br />pursuant to Indiana Code 34-13-3-4, as amended from time to time. Under said statute, <br />the City's liability is limited to: <br />1) Seven hundred thousand dollars ($700,000) for a cause of action that accrues on or <br />after January 1, 2008; and <br />2) Five million dollars ($5,000,000) for injury to or death of all persons in that <br />occurrence,; and <br />3) A governmental entity or an employee of a governmental entity acting within the <br />scope of employment is not liable for punitive damages. <br />B. Additional Insureds: <br />1. The following persons or entities are to be listed on Owner's general liability policies of <br />insurance as additional insureds, and on any applicable property insurance policy as loss <br />payees, as provided in Paragraph 6.04.B; <br />a. <br />Engineer <br />b. <br />Engineer's Consultant <br />C. <br />Engineer's Consultant <br />2. During the term of this Agreement the Engineer shall notify Owner of any other Consultant <br />to be listed as an additional insured on Owner's general liability and property policies of <br />insurance. <br />3.
