e-3 2 5) SIDEWALK IMPP,01TE E71T RESOLUTION NO. 310* Resolved by the Board of Public Werksof the City of South Bend, St. Joseph County, State of Indiana, . That it is deemed necessary to improve PENNS)YLVANIA AVENUE FROM NIGH STREET TO MIAMI STREET by th4 grading of both sides of said street for the construc- tion of cement sidewalks and the construction of the same, 'tvhere the same is not already constructed and such improvement is now ordered, in accordance with the profile., details, drawings and specifications now on file in the Office of the Department. of �the Board of Public Works of said City) and such improvement is now ordered. The cost of said improvement, including the cost of street and alley inter- sections, shall be assessed upon the real estate abutting on said Peinsylvania Avenue all according tot he method and manner provided for in an Act of the General Assembly of the State of Indiana, e,ntitled,,"An Act Concerning Municipal Corporations, " approved March 6th.,19p5,,and in accordance with and pusuant to the provisions of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assess- ments, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per amum. A bond or bonds shall be issued to the contractor in pay merit of such work, unless the property owners pay assessment before said bond or bonds are issued. Under no circumstances shall the City of South Bend,, be.' or be held responsible for any sum or sums, due from said property owner or owners for said work or for the col- lection of the same,, or for the pyyment of any bond, bonds, certificate, or certificates, issued L to said contractor in payment for such work, except for such i--oneys as shall have been'actually received by the City from the assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All proceddings had, and work done in the. making of said improvement, assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided for in said above en- titled Act and amendments thereto,* Notice of this resolution 1914 and on the lst. day of.May.1914 in give a hearing on this resolution in its May,1914 at 7:45 P.M. Adopted this 21st., day of April.1914. shall be published on the 24th. day of April, the South hend, Daily Tribune. A remonstrance was received and placed on file from property holders on Blaine Avenue remonstrating against pavement of same. President.
