ryry7 ems' ,'3 TRUNK SEWER IMPROVEMENT RESOLUTION NO. 309. RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND,COUNTY OF ST. JOSEPH,STATE OF INDIANA: That it is desired and deemed necessary to construct a sewer in LEER STREET RIND Ci\LVERT STREET, FROM THE ST. JOSEPH RIVER TO VERNON STREET. all in said City, which, from its size and character, is not only intended and adapted for use by property owners whose property abuts along the line of .said sewer, but is also in- tended and adapted for receiving sewage From collateral drains already c' nstructed or which may be hereafter constructed, and the same is hereby ordered constructed in and along the following line in.said City,to-wit:. Begin. at the St. Joseph River where the center line of Leer Street produced northerly inte-rsects same; thence southerly on the center line of Leer Street produced to a point_ on Vistula Avenue about five feet south of the northerly curb line- with an 19 inch vitrified pipe sewer; thence still southerly on the center line of Leer Street to the center of Dubail Avenue west with an 24 inen vitrified pipe; thence still south on the center .line of said Leer Street to the center of Calvert Street east with a 20 inch vitrified pipe sewer; thence east on the center line of Calvert Street to the center line of Vernon Street south w: th a 15 inch vitri- fied pipe sewer. Together with the necessary Hanholes, Inlets and House9 connections to the curb line along the line of said improve- ment . And to be. built in accordance with the profiles, specifications, detail plans, maps and estimates now on, file in the office of the Department of Public Works of said City, which includes an estimate of the proportion that the cost of an adequate local sewer, built along the above line, bears to the cost of the main sewer, to be built as follows: The cost of an adequate local sewer, built along the line above described ,is hereby estimated and Fixed to. be _ of the cost of the main sewer to be built along said line as above set .forth , which proportion, as herein_ estimated and fixed, shall be taken and adolited in all computations requiring a knowledge of .the cost of such local sewer if built along the line where the main sewer is to be built. The` cost of the construction of said sewer shall be divided as follows: 1. So much of such cost as shall be equivalent to the construction, of an adequate local sewer not adapted to receive sewage from collateral drains or sewers, if built along the propsed line as hereinabove set forth, shall be paid by the abutting pro- perty holders and the City of South Bend, if it be determined that said City -is'benefited by said sewer in the same manner and to the same extent as local sewers, are paid -,for by them, under the Statutes in such cases made and provided. 2. The excess of cost over and above what would be equivilent to the cost of a local sewer, if built alo- g said line, shall be assessed against each piece of property in the district or area to be drained and against the City, if it be dett.-mined that the said City if benefited by the said sewer, according to the manner and method presetibed by law, all of which said property beneficially affected lies within the following -described territory in the City of South Bend, County of St. Joseph, and State of Indiana,t®:wit: Begin on the southerly bank of the St. Joseph River at a point where the westerly line of Lot "V" Leer's Survey intersects same; thence south westerly along the westerly line of said lot "V" and lot _ in Leer's Survey and the westerly line of lot 6 produced to the southerly line of the Lake Shore & Hic.Ugan Southern Railway Cogs right--of-way thence easterly along said Railway Cots right-of-way to a point in line with the west line of Lot 6 Demlert s First Addition; thence South along the west line of said lot 6 to the F rst Alley North of Indiana Avenue; thence west along said alley to the north and south alley between lots 90 and 91 of Replat of Leer's Second Addition; thence south along said alley to the south lime of Indiana Avenue; thence south along the east lire of lot 5 Fisher's South Side Survey to the First Ailey south of Indiana Avenue; thence east along said alley to the first alley east of urine Street; thence south along said alley and said alley produced to the center of Ewing Avenue; thence east along the center line of Ewing Avenue to a paint 150 feet east of the east line of Leer Street; thence north parallel with and 150 feet east of tn.e east line of said Leer Street to a point 120 feet south of the South line of Calvert Street; thence east parallel with and 120 feet south of the south line of said Calvert Street to to the center of Vernon Street;
