<br />Bids were received, opened and read for pavement on Cedar Street iron
<br />JEmerick Street to Eddy Street, under improvement Resolution No. 295. In the City "of
<br />South Bend, Indiana. The same were all referred to the City Civil Engineer for tabu-
<br />lation*
<br />J. E. Kaley appeared before the Board filing plans blue ::priht;3 and a
<br />description of Keley's Lincoln Highway Addition. The same was approved by the Board.
<br />Communication received from the Chicago, South Bend & Northern Indiana
<br />Railway Compa:nrelative to broken trick and asphalt pavement between their tracks....
<br />The Street Commissioner was instructed to make a list of the defect;ve places and
<br />report the same to the Railway Company*
<br />Conn-unication received from Elmer D. Rex in regard to sidewalk inter-
<br />sections. The same was placed on file, and the Street Commissioner was instructed to
<br />N investigate.
<br />Blue print of the Chicago, Lake Shore and South Bend Railway Com-
<br />pany's approach to their barns, was approved by the Board and the following resolu-
<br />tion was adopted.
<br />RESOLUTION.
<br />Upon motion of Arthur H. Rice, seconded by John. B. Weber, the Board
<br />/ of Public Works of the City of South Bend, Indiana unanimously adopted the fallowing
<br />V/ Resolution: -
<br />Whereas, on the 25th., day of April,1913 the Board of Public Works of
<br />said City, by its written contract, granted certain rights and privileges to the
<br />Chicago, Lake Share & South Bend Ry. Co., and to the Chicago, South Bend & Northern
<br />Indiana Ry. Co., which written contract was ratified and approved by ordinance by the
<br />Common Council of said City on April 29th., 1913 ,being Ordinance No. 1675.
<br />And, whereas Section No. Seven (7) of said written contract provides
<br />as follows: -
<br />"Said companies are also hereby authorized to construct, maintain and
<br />operate such "Y'S", turn -outs, cress-evers,poles,wi.res, and overhead construction
<br />work as may be or become necessary to connect their respective tracks with their exist
<br />ing tracks on the Streets herein mentioned and on other streets and so as to provided
<br />proper facilities for the routing of cars for city service and proper facilities for
<br />the movement of cars in and out of the respective stations, waiting rooms, terminals
<br />and yards of said corpanies, and so as to connect with -each other in the inter-
<br />change of traffic,and ane,,a:lso authorized to construct, maintain and operate "Y'S",
<br />turn -outs and tract arrangements as may be or become necessary to accommodate the
<br />respective companies in the use of any union station at or near any of the junction
<br />points or joint trackpoints of the respective companies now hereafter established.
<br />Provided, always that before either of said companies shall install any tract
<br />arrangement, "Y'S",turn-outs, or cross-overs tntended for the movement of cars in
<br />Pnd out of their respective stations, waiting rooms, terminals, and yards, or in-
<br />tended to connect each other's tracks for the interchange of traffic, tl*t a drawing
<br />shall be furnished to the Board of Public Works, showing the location of the special
<br />work"Y'S", turn -outs, cross-overs, and track arrangements and thereupon the said
<br />Board of Public Works of said Cit-qT shall approve only such necessary work to accom-
<br />plish the purposes herein intended, and said work shall thereupon be constructed as
<br />approved by said Board of Public Works and in the manner as by them indicated and to
<br />their satisfaction' and not otherwise. "
<br />And, whereas, said Chi cago, Lake Shore & South Bend Railway Com-
<br />pany has filed with the said Board of Public Works a drawing or blue-print,showing t%ie
<br />location of its site for car barn and terminal facilities, which is located on
<br />the north side of East La Salle Avenue between Hydraulic Avenue and Sycamore Street.
<br />Therefore, be it resolved by said Board of Public Works of said City
<br />that said drawing so submitted by said Railway Company's in all things approved, and
<br />said Company is in all thing& approved, and said Company is authorized and em-
<br />powered to construct its tracks, "Y' S",turn-outs, cross overs and track arrangements as
<br />is shovrm in said :drawing or blue -print ,which drawing is made a part of this
<br />resolution.
