<br />surety are held and firmly bound unto the municipal City of South Bend, indiaxa, here-
<br />inafter called the obligee), in the full and just sum of
<br />TWENTY—FIVE THOUSAND ($25,000.00 )DOLLARS,
<br />lawful money of the United States, to the payment of which sum well and truly to be made,
<br />the said prinicipal binds itself, its successors and assigns, and the said surety binds
<br />itself, its successors and assigns, jointly and severally, firmly by these presents, for

<br />WHEREAS, said prinicipal entered into a certain written contract with
<br />the obligee, dated November 24th. ,1913, and ratified, by Ordinance No. 1702, of the
<br />Common. Council 4f said City, on December gth.,1913, for the lighting of the streets,
<br />41leys, boulevards and public places of said City, for the period of Ten (10) years,begini
<br />With January .lst.,1915, and all in accordance with certain plans and specifications provi—
<br />ded thereforby said obligee, which plans and specifications are a part of said contract.
<br />NOW,THEREFORE, the condition of the foregoing obligation, is such that
<br />if the said prinicipal shall well and truly indemnify and save harmless the. said ®bligee
<br />from any pecuniary loss resulting from the breach of any of the terms, covenants and
<br />conditions of the said contract on the part of the said principal to be performed then
<br />this obligation shall be void; otherwise to remain in full farce and effect in law;
<br />PROVIDED, however ,that this band is issued subject to the fallowing conditions and provi—
<br />sions:,
<br />That in case of such default on the part of the principal the surety
<br />shall have the right,if it so desire, to assume and complete or procure the completion of
<br />said contract;.and in case of such default, the surety shall be subrogated and entitled to
<br />11 the rights and properties of the principal arising out of the said contract and
<br />Itherrr'ise,including all securites and indemnities theeetefore received by the obligee..'=
<br />and ail deferred payments, retained percentages and credits due to the principal at the time
<br />of such default, or to become due thereafter by the terms and dates of the contrast.
