Kuespert, Chief of Police: "July 31. 1933 The Honorable Board of Public Safety, South Banc';, Indiana. Gentlemmen: I her transmit to you a communication received by me from the Mayor. The ?purported resignation was given to the i before my, incumbency in office. I call your attention to the fact that the :`Mayor of the City is not the proper person to receive and act upon any resignation of its chief of police. That is a perogative of the department of Public Safety. I am advised that any instrument purporting to be a resignation given to be held even.by the appointing power for use at its pleasure is contrary to public policy and void. Consequently subject to your jurisdiction as to the duration of my tenure, I am continuin as Chief of Police. Yours Respectfully John B. Kuespert, Chief of Police."
