Kuespert, <br />Chief of Police: <br />"July 31. 1933 <br />The Honorable Board of <br />Public Safety, <br />South Banc';, Indiana. <br />Gentlemmen: <br />I her transmit to you a communication received by me from the <br />Mayor. The ?purported resignation was given to the i before my, <br />incumbency in office. <br />I call your attention to the fact that the :`Mayor of the City is not the <br />proper person to receive and act upon any resignation of its chief of <br />police. That is a perogative of the department of Public Safety. I <br />am advised that any instrument purporting to be a resignation given <br />to be held even.by the appointing power for use at its pleasure is <br />contrary to public policy and void. <br />Consequently subject to your jurisdiction as to the duration of my tenure, <br />I am continuin as Chief of Police. <br />Yours Respectfully <br />John B.
