So it won't be heard by the Area Plan Commission until May 15th which means it would fall on your second May meeting. Committeemember Ferlic made a motion to continue Bill No. 14-18 until May 29th, 2018. Committeemember Voorde seconded this motion which carried by a voice vote of five (5) ayes. Bill No. 05-18- Rezoning for property located at 3527 Lincoln Way West- Notification (Committee of the Whole & Council Portion Only at 7:00 P.M.) Committee Chair Davis stated, This will be heard toni ht during the Committee of the Whole. Councilmember Karen White requested a report from the Council Members that facilitated the conversations between the parties. Committee Chair Davis then requested the Council Attorney to overview the written commitments. Bob Palmer, Council Attorney with offices on the 4th floor of the County-City Building, stated, These written commitments have been prepared and executed. They were passed out to Council. They have gone to APC and there were concerns regarding some technicalities and formalities of the written commitments. What you have now are the revised commitments submitted to you all last week. Substantively they are the same,procedurally and technically they comply with the APC concerns. Substantively these were sent to you last week. They just now have made the changes to comply with the APC requests. Committeemember Ferlic stated, It was my thought, too, that since there is an amended request being made that the petitioner could describe the written requests. Mr. Palmer replied, Since there are additional commitments,the Council can address the petitioner on those additional commitments. It is not going to be open to the public. As far as the timing of the commitments, under State Statute, commitments can be made or modified at any time legislation is being considered by the Council. So, they are not untimely if that was an issue. Councilmember Tim Scott asked, If we were to continue this matter, when is our deadline? Mr. Palmer replied, The last date to vote on it would be May 21St, 2018 so the meeting to do that would be May 14th, 2018. That is if you did not want to call a special meeting.
