We have included specific standard NIPSCO Choice program offerings, Constellation, NewEniergy - Gas Division, LLC ("CNEG") is a physical energy provider and does not provide and is not providing advice regarding the value or advisability of trading, in "commodity interests" as defined in the Commodity Exchange Act, 7 N.S.C. §§ 1-25m et seql., as amended (the "CEA"), including futures contracts, swaps or any other activity which would cause CNEG or any of its affiliates to be considered a commodity trading advisor under the CEA. We have included a copy of our base NIPSCO Choice agreements for review. The agreement governs any and all transactions for the purchase and sale of Natural Gas between CNEG and Customer. To the extent that the terms and conditions in the RFP are not addressed in the Agreement or conflict with those in the Agreement, CNEG takes exception to those terms and conditions.
