As one <br />of the largest retail gas suppliers in North America, CNEG is uniquely qualified to serve as your retail energy <br />supplier, <br />CNEG's success is built upon strength, flexibility and intense focus on customer satisfaction. CNEG is <br />committed to, superior service and unique market insight to help manage your energy costs. We have included <br />specific standard NIPSCO Choice program offerings, <br />Constellation, NewEniergy - Gas Division, LLC ("CNEG") is a physical energy provider and does not provide <br />and is not providing advice regarding the value or advisability of trading, in "commodity interests" as defined in <br />the Commodity Exchange Act, 7 N.S.C. §§ 1-25m et seql., as amended (the "CEA"), including futures contracts, <br />swaps or any other activity which would cause CNEG or any of its affiliates to be considered a commodity <br />trading advisor under the CEA. <br />We have included a copy of our base NIPSCO Choice agreements for review. The agreement governs any <br />and all transactions for the purchase and sale of Natural Gas between CNEG and Customer. To the extent <br />that the terms and conditions in the RFP are not addressed in the Agreement or conflict with those in the <br />Agreement, CNEG takes exception to those terms and conditions. <br />Thank you for the opportunity to respond to this Request for Proposal.
