REGULAR MEETING APRIL 24, 2018 131 <br />[l <br />1 <br />favorable recommendations concerning this Vacation Petition from the Area Plan Commission, <br />Fire Department, Solid Waste, Community Investment and Engineering. Area Plan stated the <br />vacation would not hinder the growth or orderly development of the unit or neighborhood in <br />which it is located or to which it is contiguous. The vacation would not make access to the lands <br />of the aggrieved person by means of public way difficult or inconvenient. The vacation would <br />not hinder the public's access to a church, school or other public building or place. The vacation <br />would not hinder the use of a public right-of-way by the neighborhood in which it is located or to <br />which it is contiguous. Therefore, Ms. Maradik made a motion to give a favorable <br />recommendation for the request for vacation. Ms. Dorau seconded the motion which carried. <br />APPROVE TRAFFIC CONTROL DEVICE <br />Mr. Gilot advised that the Fire Department along with Notre Dame students, the American Red <br />Cross, and La Casa, has submitted the following request to allow staging for their equipment <br />when they canvas the neighborhood to deliver and install fire alarms. Upon a motion made by <br />Ms. Maradik, seconded by Ms. Dorau and carried, the following traffic control device was <br />approved: <br />TEMPORARY INSTALLATION: No Parking Zone Request for Fire Department <br />Alarm Canvas <br />LOCATION: Intersection of Scott Street and Calvert Street <br />DATE: April 29, 2018, and May 6, 2018; 11:00 a.m. to 4:00 <br />p.m. <br />REMARKS: All criteria has been met <br />APPROVE CONSENTS TO ANNEXATION AND WAIVER OF RIGHTS TO <br />REMONSTRATE <br />Mr. Gilot stated that the Board is in receipt of the following Consents to Annexation and <br />Waivers of Right to Remonstrate. The Consents indicate that in consideration for permission to <br />tap into public water/sanitary sewer system of the City, to provide water/sanitary sewer service <br />to the below referenced properties, the applicants waive and release any and all rights to <br />remonstrate against or oppose any pending or future annexations of the properties by the City of <br />South Bend. <br />A. Linda Harris, 20023 Ritter Ave., South Bend, IN —Water (Key # 001-1017- <br />034401) <br />Upon a motion by Ms. Maradik, seconded by Ms. Dorau and carried, the Consents to Annexation <br />and Waivers of Right to Remonstrate were approved as submitted. <br />RATIFY RELEASE OF EXCAVATION BOND <br />Ms. Donna Hanson, Division of Engineering, recommended that the following Excavation Bond <br />be released pursuant to Resolution 100-2000 as fh11nwc- <br />Business <br />Bond Type <br />Approved/ <br />Released <br />Effective Date <br />TBE Group Inc. d/b/a Cardno TBE <br />Excavation <br />Released <br />August 18, 2018 <br />Ms. Maradik made a motion that the bond's release as outlined above be ratified. Ms. Dorau <br />seconded the motion, which carried. <br />APPROVE CLAIMS <br />Ms. Maradik stated that a request to pay the following claims in the amounts indicated has been <br />received by the Board; each claim is fully supported by an invoice; the person receiving the <br />goods or services has approved the claims; and the claims have been filed with the City Fiscal <br />Officer and certified for accuracy. <br />
