147 1 LOCAL SEWER IMPROVEMENT RESOLUTION N0. 292. Resolved by the Board. of Public Works of the City of South Bemd., County /of St. Joseph, State of In.d.iana, That the construction of a local sewer, intended and ad- apted only for local use by the property holders whose property abuts thereon, and not ix�- tend.ed or adapted for ,receiving sewerage from collateral draixs, be and the same is, hereby ordered in and a ldxg 5 BLAINE AVENUE FROM VAN BUREN STREET TO QU INCY STREET as follows , t o- wit: Bej_Kkix 9a&ttthe center of Blaine Avenge and Val. Buren -Strut, thence north along the center of Blaine Avenue to the center of Quincy Street t*rith a 12 inch vitri- fiid pipe sewer. Together with: the necessary zan,holes, inlets and house connections to the curb lin,e,a"loh.g the line of said. improvement, All as shown on the plans, profiles and detail drawings on file in the office of the Department of Public Works of the City of South. Bend, Indiana. _ And such improvement is now ordered, and said sewer, with all its appurtenances shall be constructed in accordance with the profile and. specifications n.ow ox file in the office of the Department of Public Works of said City. The cost of said im- provement shall be apportioned against and paid by the property holders whose property abuts thereon, and upon the City of South Bend if the .City is benefited by said improvement, all according to the method and manner provided for in Act of the General Assembly of the State of Indiana, entitled "An Act Concerning MunicjiAal Cvrporatioxs," approved March 6,1905. Assessmentsij if deferred, are to be paid in ten equal annual installnexts, with. interest at the rat* of Six per cent per an.num. A bond or bonds shall be issued to the contractor in payment for such work, unless the property owners pay said assessments before said bond or bonds are issued.. Under no cirsumstan.ces shall tie City of South Bead be or he held responsible fbr any sum or sums due from. said property owners for said work, or for the collection of same, or for'the payment of any bond or bonds, egrtificate or certificates i ssued to said emitractor 'in pa,ymeA for such work, except for such moneys as . shall have been actua ly received by the City from the assessments for such improvem.exts,or such moneys as said City is by said above entitled Act required to pay. All proceedings had., and work done in, the making of said improvement assessment of property, collections of assessments and issuance of bonds therefor, shall be as provided for in said above exittled Act. Notice of tYds resolution shall be published on the 25tk., day of September 1913 and on the 2nd...,day of October 1913 in the South Bend Daily News -Times, This Board will give a hearing on this resolution at its of ice in the City Hall on the 24th. dayn.of October 1913 at 7:45 P.I.
