All members present. <br />Hearing on Vacation of Kauffman's Alley.under Vacation Resolution No. 21. was deferred <br />until Friday September 26th.,1913 at 10:00 A.M. <br />, Partial estimate alloyed C.L.Headley on grade, curb and walk on. Tmnti Avenue, under Improve- <br />ment Resolution No. 267. for the amount of......................................$1,063e6O <br />/Petition filed with the Board Pop 1� tablishing a grade on Peashway Avenue. The Game was <br />read and referred to the City Engineer. <br />VPermissiox was granted to the Indiana and Michigan Electric Company to set poles and <br />anchors as follows:- <br />To reset 1 - 16' guy stub on, south side of Jefferson just east of Maple. <br />To set 5 - 35' poles on the south side of the alley north of Madison Street <br />from Arthur Street.to a point at the read of Mr. Leyes' residence, 1239 E. Madison Street. <br />Complaint was filed with the Board of a pole at 1226 South Carroll Street. The Board ap- <br />proved of the following. <br />This is an Indiana & Michigan Electric Company pole and should be <br />moved to the north about Ten (10) feet as the owner wants to build a cement driveway to get <br />coal into a new house just built. <br />SOUTH BE"NTD IP IND. Sept. 19th. 5,1913. <br />To the Board of Public Works of the <br />City of South Bend, Ixdiaxa. <br />Gentleme x: - <br />I would ask of you the privilege of sighiL.ng all my rights and interests in High <br />Street paving contract and Dunham Street contract to T.C.Barn,es on account of my health failing <br />and not being able to finish said work. Mr. Barnes will start the worn Monday morning and <br />promises to push it through to completion and get tbe, two contracts finished this fall,hopin.g <br />you will see fa,verable in granting this request, I remain, <br />Respt. yours, <br />C. H. BEFREES, <br />ASSIGNMENT. <br />FOR AND IN CODTSIDERATIO?,T of the things hereinafter mentioxed,I CALVERT H.DEFREES , do <br />hereby assign unto THOMAS C. BARNES two certain contracts for brick pavement known as High Stre <br />Street and Duxha,xt Street Brick Pavements, which sontracts were signed by me and the City of <br />South Bend, Indiana, upon hhe 26th.7 day of June 1913; said THOMAS C. BARNES hereby agreeing <br />to fully and completely carry out and perform all of the terms and conditions of said contracts <br />and specifications in reference to the same mentioned in said contracts which were incumbent <br />upon me to perform, and to save me harmless from all loss, costs and damages of any kind or <br />nature in reference to the same. <br />The said. THOMAS C . BARNES tu.rther agrees to use all of the brick that have been <br />ordered for said jobs and to pay Calvert H. Defrees for the sane, aiad also to pay all freight <br />upon the same, and the labor of unloading and piling the brick upon the street; it being under- <br />stood that the said Thomas C. Barnes is to fully and completely carry out and perform said cox- <br />tracts heretofore mentioned in this assigments of said contracts hereby consented to by the Boa, <br />Board of Public Works upon the 19th. , day. of September 1913. <br />Witness our hands and seals this i9th., day of September,1913. <br />C.
