REGULAR MEETING JULY 23. 2007 <br />Councilmember Pfeifer made a motion to hear the substitute version of this bill. <br />Councilmember Rouse seconded the motion which carried by a voice vote of eight (8) <br />ayes. <br />Councilmember Varner, Chairperson, Public Works and Property Vacation Committee, <br />reported that this Committee held a Public Hearing on this bill this afternoon and voted to <br />send it to the full Council with a favorable recommendation. <br />Ms. Marta Brummell, 914 W. Notre Dame Avenue, South Bend, Indiana, made the <br />presentation for this bill. <br />Ms. Brummell advised that the purpose of the vacation of the alley is to increase safety in <br />the area. She stated that the alley is utilized as a driveway for homes that border the <br />alley. There are young children which care often playing near the alley on a daily basis. <br />The alleyway has also been noted to facilitate vandalism and other crimes in the area. <br />Ms. Brummel stated that she will record a cross access easement between the property <br />owner and the contiguous property owners. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Pfeifer made a motion for favorable <br />recommendation to full Council concerning this bill as substituted. Councilmember <br />Rouse seconded the motion which carried by a voice vote of eight (8) ayes. <br />RISE AND REPORT <br />Councilmember Kuspa made a motion to rise and report to the full Council. <br />Councilmember Varner seconded the motion which carried by a voice vote of eight (8) <br />ayes. <br />ATTEST: ATTEST: <br />John Voorde, City Clerk Karen L. FROM FRANCES STREET TO NOTRE <br />DAME AVENUE FOR A DISTANCE OF 228 <br />FEET AND A WIDTH OF 14 FEET.
