77 LOCAL SEWER IMPROVE11ENT RESOLUTION NO. 2F)rb. Resolved by the Board of Public Works of the City of South Bend, County of V St.- Joseph, State of Indiana, That the construction of a local sewer,intended and adapted only for local*use by the property holders whose property abuts thereon, and not intendend or adapted for receiving sewerage from collateral drains, be and the same is hereby ordered in and al&ng FRANIMIN STREET FROM INDIANA AVENUE 00 dAVERT STREET AS. to —wit. Begin at the Manhole in the center of Franklin Street and tLhe north line of Indiana Avenue thence south on the center line of said Franklin Street to the center of Biancne Street' with a 15 inch vitrified pipe sewer, thence still south along the center of Franklin Street to the center of Calvert Street with a 12 inch vitrified pipri-risewero Together with the neaessarY manholes,, inlets and house connections to the curb line al(ong, the line of said improvement. All as shown on the plans, profile-s anddetall drawings on file in the office. of the Department of Public Works. And sual'i improvement is now ordered, and said sewer, with all its appur— tena:nces shs,11 be constructed in accordance ith the profile and specific&tions now on file .in the office, of the'Department of Public Works of said City. The cost of said improvement shall be apportioned against and paid by the property holders whose property abuts thereon, and upon the City of South Bend if the City is benefited by said improvement, all accordim, to the method and manner providea for in Act of the General Assembly of the State of Indiana, en— titled "An Act Concernine, i'llu'aicipal corporations,,"appreved March 6,1905, Assessments, if de— ferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bonder bonds shall be issued to the contractor in payment for such work,, unless the property owners pay said assessments before said bond or bonds are issued. Under no direunstances shall the City of South Rend be or be held responsible for any sum or sums cue from said property orne-L- or ovmers for said work, or for. the colleetion of same, or for the payment of any bond or bonds, certificate or eertifieates,, issued to said con— tractor in payment for such work, except for such rioneys 2:s sh2:11 have been metually rece— ived by the City from the assessments for such improverrient, or such noneys as said City is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessment of propertycolleations-of assesments and issuance of bonds therefor, sh_11 be as provided for in said above entitled Act. Notice of this resolution shall be published on the 3rd. day of July.1913 and on the 10th., day of July .1913,, in the South Bend Daily N6ws-"Times.
