<br />GRADE, CURB AND SIDEWALK IMPROVEhIENT RESOLUTION
<br />NO.194.
<br />Resolved by the Boa-rd of Public works of the City of South Bend, St.
<br />V/Joseph County, State of Indiana, That it is deemed n,eeaessary to improve DALE AVENUE FROM
<br />DAYTON STREET TO BOWMAN STREET.
<br />By grading said street from property line to property line, and con—
<br />structing cement sidewalk and cement curb on both sides of said Dale Avenue wrere not
<br />already constructed. All as shorn on plans, profiles and detail drawings on file i_1 the
<br />Office of Public Works.
<br />And such improvement is now ordered in accordance wit the praft le,
<br />details, drawings and specifications on file in the office of they Department of the
<br />Board of Public Works of said City; and such improvement is now ordered.
<br />The cost of said. improvement, including the cost of street and all%r,
<br />intersections .,shall be assessed upon the real estate abutting on sE idDALE AVENUE, all ac—
<br />cording to the method snd manner provided for in an Act of the General Assembly of the State
<br />Of Indiana., entitled,"An Act Concerning Municipal Corporations,"approved March 6th.,1905, and
<br />in, accordance with and pursuant to the provisions of all amendatory and supplemental acts
<br />thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred
<br />are to be paid in ten equal annual installments, with interest at the rate of Six per cent
<br />per annum. A bond or bonds sha, 1 be issued to the contractor in payment of such vork,unless
<br />the property oAmers pay said assessment- before said bond or bonds are issued.. Under no air—
<br />cumstan-ces shall the City of South Bengt, be , or be held responsible for any sur or sums,
<br />due from said property owner or -owners for. said work or for -tne collection of the same, or
<br />for the payment of any bond, boh.ds, certifieatee or certificates, issued to said contractor
<br />in payment for such work, except for such moneys as shall have been actually received by the .
<br />City from the assessments for such improvel�ent, or such moneys as said City is by said above
<br />entitled Act required to pay. All proceedings had, and work done in the making of said im—
<br />provement, assessment of proprty , collection of assessments and issuance of bonds therefor,
<br />shall be as provided for in said above entitled. Act and amendments thereto.
<br />Notice of this Resolution shall be published on the 3rd., day of July
<br />and on the loth., day of July,1913 in. the South Bend Daily News —Times. This Board will give
<br />a. hearing on this resolution in its office in the City Hall on the 25th., day of July,1913
<br />at 7:45 P.M.
