SIDEWALK IMPROVEME"T RESOLUTION NO. 267. a Resolved by the Board of Public Works of th.e City of South Bend; St. Joseph County,State of Indiana,That it is deemed nece� nary to. improve TONTI AVE. from LAFAYETTE STREET TO IROQUOIS STREET. By grading the said street from property line to pro— perty line and constructing cement walks and curb on both sides of said street. All as shown on plans and in accordance with profiles, detail drawings and specifications on file in the office of the Department of Public Works of said City. And .such improvement is now ordered in accordance vrith the profile, details, drawings and specifications on file in the office of the Department of the Board of Public Works of said City; and such improvement is now ordered. The cost of said improvement,including the cost of street and alley intersections, shall be assessed upon the real estate abutting on said TONTI AVENUE all according to the method _nd manner provided for in an Act of the General Assembly of the State of Indiana,entitled "An Act Concerning Municipal Corporations," approved March 621905, and in accordance with and purusant to the provisions of all amend— atory and supplemental acts thereto, passed by the General Assembly of the State of Indiana, Assessments, if deferred, are to be paid in teen equal annual installments, with interest at the rate. of Six per cent per annum.. A bond or bonds shall be issued to the contractor in payment of such work, unless the property pwners pay said assessment before said bond or bonds are issued. Under no circumstances shall the City of South Bend, be or be held responsible for any sum or sums, due from said property oviner or otvners for said work or for the collection of the same, or for the payment of any bond, bends , certificate or certi— ficates,,issued to said contractor in payment for such work,except for such moneys as shall have been actually received by the City from the assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All proceedings, had, and work done in the making of said im;)rovement,, assessment of property,colleetion of assessments and issuance of bonds therefor, shall be es provided for in said above entitled Act and amendments thereto. Notice of this resolution shell be published on .the 12th. day of may21913 and on the 19th., day of Ma:y9,1913 in the South Bend, Daily Times,This Board will give a hearing on this resolution in its office in the City Hall on the 13tr1. day of June.1913 at 7:45 P.M.
