<br />Hearing had on -Vacation Resolution No. 80 for the vacation of
<br />alley lying south of'Lots 1,2,3, & 4 also the 14 fool, alley running east, and rest,
<br />and _north of Loots 8 all in Johnson's Sub. Division of lot, 18 in Cottrell's First
<br />.Addition to.the-town of Lowell now,a part of City of South Bend, Inc ana.
<br />In the above matter no remonstrators appeared and no written remora
<br />sttanoe was filed, The Board being fully advised in the matter takes final actb
<br />action on said resolution, confirming without modificat�ins , all former action
<br />taken on the same,
<br />-The Board therefore_declares.the above property in all things
<br />condemned and appropriated,for public use, and the Board now orders that, a list,
<br />or roll be prepared of all the owners or holders or property and_of valuable in-
<br />terests therein souht;'to be taken or to be injuriously affected, which list or
<br />rollshall also describe the property beneficially affected.
<br />Hearing had on Resolution for the Vaeatioh of aleley lying between
<br />Lots 16,17, 18 and 25 in John A. Swygart's Third Additiob from Magnolia Street
<br />to the first alley east of Magnolia Street, under Vacation Resolution No. 79.
<br />In the above matter petitioner appeared and requested that hearig
<br />be continued so�that deed for new alley could be prepared, said hearing hereby
<br />continued to Wednesdagr October 31st., 1923 at 7:15 P.M.
<br />Hearing had on roll of awards of damages and assessmeais of bene-
<br />fits for:the Opening of alley eight (81) foot wide m*xxx off of west side of lot
<br />2 in Dunbar's Sub..Div. ov B. 0. L. 31 and 32 from Washington Avenue to First aik
<br />Alley north of Washington Avenue under Condemnation Resolution No. 70.
<br />In the above matter Atty. Seybold appeared representing J. D.
<br />Oliver and abjeeted to amount of damages allowed on Oliver property, but no
<br />written remonstrances were filed. The Board find that the property assessed in
<br />said roll filed May 9th., 1923 is benefitted and damaged respectively as shown on
<br />said roll 'as shown in files of Board, and said roil is hereby in all things
<br />ratified, confirmed and approved as originally filed, and all axtion under
<br />Condemnation Resolution No. 70 is hereby concluded. ( Insert see files for Roll]

<br />Avenue under Improvement Resolution No. 1146. Filed October 2nd., 1923._
<br />Water connections on Sunnyside Avenue from Washington Avenue to
<br />La Salle Avenue under Improvement Resolution No. I243, Filed October 2nd., 1923.
<br />Water connections on Al%geldt Street from Erskini Blvd. to Nigh
<br />Street, under Improvement Resolution No. 1244. Filed October 2nd., 1923.
<br />In the above matter no remonstrators appeared and no written
<br />remonstrance was filed. The Board therefore find: that the property assessed in
<br />said rollsfiled October 2nd., 3rd. and loth. 1923 are benefited in the amounts
<br />as shown n said roll, and the Board further find , that the assessment rolls
<br />filed October 2nd, 3rd. and 10th.r 1923 and the final estimates allowed October
<br />2nd., 3rd:. and 10th.0 1923 should be and the same are hereby in all things rati-
<br />fied confirmed and approved.
