<br />petition, like any ether part, of the streets of the Cite,wis within the control
<br />of the Board Of Public Works. The grade of said', Street is established by the -
<br />.erection of the Colfax, Avenue Bridge. It is entirely competent for the Board of
<br />Public Works to order the construction of the sidewalk along the south side of
<br />said street at the same grade, or the Board may permit the abutting property
<br />owners to constrict said sigewalk, w
<br />Theseis no- obligation,resting upon the' -Board to keep this driveway
<br />roterred to, and which is not at the=same grade as. the street, open -for the bean`
<br />fit of :property owners in thart..Vicinity. The. fact that .t,hese property owners
<br />have used the same for more than twenty years is net material.
