4 <br />ORDINANCE NO. 1051l4" 1r1 <br />AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: <br />EASTERN 17O* FEET OF EAST/WEST ALLEY WEST OF EDDY STREET BETWEEN ST. VINCENT <br />STREET AND HOWARD STREET <br />STATEMENT OF PURPOSE AND INTENT <br />Pursuant to Indiana Code Section 36-7-3-12, the Common Council Is charged with the authority to <br />hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates <br />the above described public property. <br />NOW, THEREFORE;, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, as follows: <br />SECTION I. The Common Council of the City of South Send having held a Public Hearing on the <br />petition to vacate the following property: <br />All of tho 14 loot wide Easf/Wesl alley tylnp between Lots 97 and 98 in Sorin's Second <br />Addillon to the Town of Lowe# recorded in Plat Bank 1, page 10 in the Office of the <br />Recorder of St. Joseph Counly, Indiana, said Alley Is bordered on the East by Eddy <br />Street and on the West by the first alley West of Eddy Street, Contalolnp Z, 310 square <br />feet, more or less. <br />hereby determines that it is desirable to vacate sold property. <br />SECTION If. The City of South Bend hereby reserves the rights and easements of all utilities and <br />the Municipal City of South Fiend, Indiana, to construct and maintain any facilities, Including, but not limited <br />to, the following: plecir€c, telephone, gas, water, sower, Surface water control structures and ditches, within <br />the vacated right-of-way, unless such rights are released by the Individual utilities. <br />SECTION.Ilt- The following property may be Injuriously or beneficially affected by such vacating: <br />018.5105.3698 <br />018-5tD5.3f399 <br />f1 <br />1717010 <br />
