II. ZONING CRITERIA <br /> As in any rezoning petition it is reviewed by Area Plan Commission("APC")staff for presentation <br /> to the APC at a public hearing. Attached is the staff's findings and recommendation in favor of this <br /> rezoning. The criteria under Indiana Law I.C. 36-7-4-603 which a reviewing body like the Council are <br /> addressed in the report, and summarized: <br /> • Comprehensive Plan-the proposed use of the Property by WCC meets the West Side Main Streets <br /> Plan and the Comprehensive Plan of the City of South Bend. <br /> • Current Conditions and Character - Lincoln Way West is a mix of commercial and office <br /> businesses. To the north and south of the Property and others on Lincoln Way West are residential. <br /> • Most Desirable Use-APC Staff has stated it is office or commercial use. <br /> • Conservation of Property Values-APC staff has stated property values should NOT be affected <br /> negatively. <br /> • Responsible Development and Growth - it is reasonable development and growth to encourage <br /> development of office and commercial uses in the mixed use node where the property is located. <br /> The Staff Analysis is particularly important to review: <br /> "Rezoning this property to OB; Office Buffer will correspond well with the adjacent <br /> commercial and office properties along Lincoln Way. The rezoning corresponds with the <br /> City Comprehensive Plan and the Bendix Node(West Side Main Streets,2014)which this <br /> parcel is located." <br /> Attached I am providing:(i)copies of the Area Plan Commission Staff Report;(ii)relevant portions <br /> of the City Plan approved 2006; and (iii) relevant portions of the West Side Main Street Plan. Within the <br /> materials provided from the comprehensive plan is the resolution of the South Bend Common Council <br /> approving the City Plan on November 13,2006. Also included are the objectives of the City Plan referenced <br /> in the Area Plan Staff Report(Objective LU 2.2: "pursue a mix of land uses along major corridors and other <br /> locations identified on the future land use map", and Objective ED 73: "support neighborhood based <br /> economic opportunities as identified in area-specific plans." <br /> The West Side Main Street Plan is such an area-specific plan contemplated by the City <br /> Comprehensive Plan. In the materials provided from the West Side Main Street Plan,there is a map which <br /> describes certain NODES of development. As mentioned in the Area Plan Commission Staff Report,3527 <br /> Lincoln Way West is in the Bendix Node. <br /> The Bendix Node is described in the West Side Main Street Plan as an area appropriate for <br /> commercial and medical office uses.' The use of this property by WCC is compatible with the West Side <br /> Main Street Plan and therefore consistent with the Comprehensive City Plan approved by this Council. <br /> Although the property to be rezoned is in the Bendix Node, which allows a more aggressive use, <br /> the WCC plans to keep the property homelike and residential in character. Significant dollars will be <br /> expended to upgrade this property and contribute to the beautification of the neighborhood. WCC's plan <br /> includes new siding, the elimination of 2 industrial looking outbuildings,the addition of new landscaping, <br /> ' As mentioned in the introduction,the WCC is more than just a medical clinic in that it provides other needed <br /> services. <br /> Page 2 of 4 <br />
