75 <br />Board met in•regular session at 7:15 P.M. All members present. <br />Hearing had on resolution for the improvement of Wayne Street from <br />St. Louis Blvd. to Eddy Street, under Improvement Resolution No. 1129 for the paving of <br />same _ <br />In the above matter remonstrators appeared and a written remonstrance <br />was filed. The Board after hearing all interested parties present, decided to defer action <br />on said resolution until Wednesday April 18th., 1923 at 7:15 P.M., and remonstrance referred <br />to City Engineer to check as to majority of names and report on same Wednesday.April 18th., <br />1923 at 7:15 P.M. <br />City Attorney L..W. Hammond with Atty. G. A. Farabaugh appeared before the <br />Boara� and :disoi�>3sed the law suit now.p�&nding of Andrysiak vs :the City in .regard to the <br />Widening of Johnson Street. The Board advised the City Attorngy to take whatever action <br />necessary in this matter, no action taken by the Board. <br />Hearing hadonresolution for the grade, curb and walk on Johnenn <br />Street from Humboldt Street, to Elwood Avenue under Improvemgnt, Resolution No. 1123. <br />In the above matter.Mr. Andreysiak appeared but no written remonstrance <br />was filed. The Board being fully advised in the.premises, decides that,the benefits <br />to property liable to be assessed for amid improvement are equal to the estimated cost of <br />the same , as reported by the City Civil Engineer, and thereupon takes final action on said <br />resolution as originally adopted, -and the same is hereby in all things, ratified, confirmed <br />,and approved. <br />Resolved further, that notices be published on the i2th. day of April <br />1923 and -on thel9th. day of April 1923 in the South.Bend.News Times and Tribune in said City <br />stating than this Board will receive bids for the doTistrualianoe'f said improvement up to <br />10:00 A.M. Tuesday -May lst._,.1923. The Board reserves the right °to reject any and all bids. <br />Hearing had on improvement Resolution No. 1130, for the pavement on <br />Yukon Avenue from Portage Avenue to Riverside Drive, in the City of South Bend, Indiana. <br />• Upon said hearing no remonstrators appeared and no written remonstrance <br />,was filed. The Board` therefore being fully advised irl •the premises, decides that the bener- <br />�fits to proert,y liable to be assessed for said improvement are equal to the estimated cost, <br />of the same, as reported by the City Civil Engineer, and thereupon takes final action on <br />said resolution as originally adopted and the same is hereby in all things, ratified, confirm <br />and approved. <br />Resolved Furth_r, that, notices be published on the 12th. day of April. <br />1923 and on the i9th. day of April 1923 in the South Bend News Times and Tribune in said <br />City, stating that this Board -will receivesbids for the construction of said improvement <br />up to 10:00 A.M. May 1st., 1923. The Board reserves the right to reject ant and all bids. <br />Hearing had on Improvement Resolution No. 1128. for the pavement on <br />Miner Street from St. Peter Street to -Notre Dame Avenue, in the City of South Bend, Indiana. <br />Upon said hearing no remonstrators appeared and no written remonstrance <br />was filed. ( AttY. Bergan appeared and requested that pavement improvement be extend to <br />Eddy Street, same not granted.) The Board being fully advised in the premises, decdes that thi <br />the benefits to property liable to be assessed for said improvement are egaul to the estimated <br />cost of the came, as reported by the City Civil Engineer, and thereupon takes final action <br />on said resolution as originally adopted and the same is hereby in all things, ratified, can -- <br />firmed and approved._ <br />Resolved further, that notices be published on the 12th. day of April <br />1923 and on the 19th. day of April 1923 ih the South Bend News Times and Tribune, in said City'. <br />stating that this Board will receive bids for the constretion of such improvement up to 10:00 <br />A. M. Tuesday May 1st., 1923. -The Board reserves the right to reject any and all bids. <br />
