58 WAIVER. 4 TO THE BOARD OF PUBLIC WORKS SOUTH BEND, INDIANA. WHEREAS, the Board of. Public Works of the City of South Bend, Indiana, did on the 41Jh: day of April 19230 192. ,adopt a prelimnary resolution for the d tao -Pram Lbe Morth l Jine of VAr Buren Stroot tothe south line of California Aveme. r- Under Improvement Resolution No. in the City of South Bend, Indiana by construction of a sewer, also the construction of. the necessary manholes and inlets, storm water inlets, conduits and re:ettirg all manholes and inlets to the proper grade, all as shown on the plans and in accordance with the profiles, detail drawings and specifications i on file in the office of the Department of Public Works. AND WHEREAS, we, the undersigned are the only persons owing property on the said street to be improved, and that we are alone affected in any way by said proposed improvements. ?hat we are the s-)le owners of the separate parcels of land bordering upon said street proposed to be improved. THEREFORE, in consideration that said Board of Public Works proceed to improve said x street known as - SaMeeme Avenue from the north line of Van Buren Street to-otarth 1-tine of Ch T i fo rnis Avenue I as proposed in said resolution, and for the further purpose of saving time and expense, we the undersigned, do hereby waive all objections on and in defense to an defect in said proceedings, and t �= _ 9 p gs, o any violation in procedure for the oon- _ Oruction of sewers as fisted by Section 8722 of Burn's Revised Statutes of 1914. We further waive any right to object to the farm of said resolution. We further waive any and all objections to the fact that no advertisement for bearing was published as required bylaw, and that no notices were trailed tc the owners of Fror-erty and that no f.er- ring was held by said Board. We also consent that said Board shall proceed to let the contract for doing said work in the -^ _ following manner: That they shall notify by mail responsible contractors in the City of South Bend, Indiana of said work to be done under said resolution, and that they shall receive bids from said contractors for doing of said work and they shall let the contract for the d )ing of the said work to tie lowest responsible bidder. And we waive .any objection to the action of said Board in letting said contract in a form and manner other than provided by law.. i And we further consent that the cost of doing said work shall be assessed against the different parcels of real estate owned by us as provided by Sections 8722, 8724, 8725, 8726, 8727, 8728, and all acts and laws amendatory thereof or supplemental thereto. And we further agree that notice given us by mail shall by sufficient notice of the hearing upon on the assessment .made for said improvement.
