1.9 <br />f <br />Board met in regular session at 9:00 A.M All members present. <br />George A. 'vis Commissioner of Buildings appeared before the Board <br />and requested permission be grannted the H. G. Christman Company to close lat. alley <br />south of Jefferson Street from Michigan Street to lat. alley west of Michigan Street, <br />along the south.side of the Auditorium Theatre Building for°a period of ninety (90) days <br />on account of wrecking old building and erecting new,bu.ilding on Auditorium site. Same <br />granted by the Board. Proper barricades to be placed and red lights, and police and Fire <br />Department notified. <br />Mr. R. R. Smith, Mgr of the Chicago, South Bend & Northern Indiana <br />Railway Company appeared before the Board.,'and presented the following letters, and <br />discussed the paving and matters pertaining to same with the Mayor and Board. <br />The following communication received from Mr. Smith of the Chicago, <br />South Bend & Northern Indiana Railway Company was approved by the Board. <br />TO THE BOARD OF PUBLIC WORKS AND THE MAYOR OF THE CITY OF SOUTH BEND, INDIANA: <br />Gentlemen:— <br />In regard to our verbal understanding of even date ; in connection.with the <br />request contained in my letter dated March 15th., asking permission to build additional <br />tracks within the City of South Bend. Four paragraph in letter modified by R. R. Smith. <br />It is understood and between the Cityp as represented by the Board of Public <br />Works, and the Chiehgo, South Bend & Northern Indianan Railway Company that on Marietta <br />Street this company will pay forthe pavement of that portion of the street occupied by <br />its double tracks, between the tracks and for one foot outside, It is also undeerstood <br />that the present north end of the Marietta Turnout will be moved as -near Broadway as <br />possible. <br />On Indiana Avenue .where •it -will •be •neoessary •to tear up the present pavement, <br />the Railway Company will agree -to -clean -and •replace •the present brick where it is in first <br />class condition. If any brick is found to be badly worn,"hew brick will be substituted. <br />`It is also understood ,between 'the Board of Public Works and the Railway Company, <br />that the attorney for the_ Railv1sy'Cdnipany'lt to prepare the necessary papers in the form <br />of a contract, so that the `Railvve�y ;Company ,can ,eke advantage of the ten year plan of <br />payment of the cost of the pavement whielt ,is .iApia�lled, on Marietta Street. In all instances <br />the City engineer will decide ,vghetjher, _ol.ct .brick it fit'for use and no old br1Qk shall be <br />used without; his. approval . <br />1460 is also understood hatween the Board of Public Works and the Railway Company <br />that in all other work for which permission was asked that, the Railway Company will use <br />now brick wherever the old brick�is too badly worn to be replaced. <br />This letter is fwvmrded in duplicate and it is requested that if it <br />meets with the approval of the Board of Public Works that it be stamped approved and on <br />copy be returned to the Railway Company for its filed, <br />APPROVED <br />APR. 3,1923• <br />BBARD OF PUBLIC WORKS <br />BY L. Mgr. <br />The following communication received read and placed on file and Clerk <br />instructed. to file same away until further action is taken on same. <br />Tuesday March 27th., 1923. <br />TO THE MAYOR AND BOARD OF PUBLIC WORKS <br />Gentlemen: - <br />With reference to the proposed improvement of Lincoln Way East <br />from Michigan Street to Sample Street,. the Railway Company proposes as follows: <br />First: It will put its tracks in a proper condition to receive pavement <br />between Jefferson Street and Sample Street, <br />Second: Prom the end of its present double track on Lincoln Way <br />East,, near Carroll Street, it will lay a new track to the corner of Michigan Street, <br />which will be put in a eonditioh to receive pavement. <br />
