REGULAR MEETING JUNE 25, 2007 Mr. Robert Holmer, 127 N. Sheridan, South Bend, Indiana, spoke in favor of this bill Mr. Holmer advised that he would like to see the ban of fireworks altogether. He stated that they pollute the air quality and violate the clean air act. Mr. Jerry Niezgodski, 2930 Bonds, South Bend, Indiana, asked whether the violation must be witnessed by a police officer. In rebuttal, Mayor Luecke responded to Mr. Holmer's comments and advised that State Law rules and this bill mimic's the recently passed legislation by the State. In reference to Mr. Niezgodski's question, tickets must be witnessed and issued by a police officer. Councilmember's Kirsits, Pfeifer and Varner offered their comments on this bill. They encouraged public awareness on this issue. There was no one present wishing to speak in opposition to this bill. Additionally, Councilmember Varner made a motion for favorable recommendation to full Council concerning this bill. Councilmember Dieter seconded the motion which carried by a voice vote of nine (9) ayes. RISE AND REPORT Councilmember Pfeifer made a motion to rise and report to the full Council.
