REGULAR MEETING <br />AN <br />OCTOBER 13, 1980 <br />The regular meeting of the Board of Public Works was convened at <br />9:30 a.m. on Monday, October 13, 1980, by President Patrick M. <br />McMahon, with Mr. McMahon and Mr. Richard L. Hill present. <br />Deputy City Attorney Terry A. Crone was also present. <br />MINUTES OF PREVIOUS MEETING APPROVED <br />Upon a motion made by Mr. Hill, seconded by Mr. McMahon and carried, <br />the minutes of the regular meeting of October 6, 1980, were approved <br />as submitted. <br />OPENING OF BIDS - BIRDSELL STREET CURB AND SIDEWALK IMPROVEMENTS <br />This was the date set for receiving bids for the curb and sidewalk <br />improvements for Birdsell Street (CD 79- 303 -C). The Clerk tendered <br />proofs of publication of notice in the South Bend Tribune and the <br />Tri- County News which were found to be sufficient. The following <br />bids were opened and publicly read: <br />Carl J. Reinke & Sons <br />721 N. College <br />South Bend, Indiana <br />$45,408.45 <br />Ziolkowski Construction <br />1005 S. LaSalle <br />South Bend, Indiana <br />Bid was signed by Harold G. <br />Reinke, non - collusion affidavit <br />was in order, and a bid bond in <br />the amount of 5% of the bid <br />was submitted. <br />Bid was signed by Ben Ziolkowski, <br />non- collusion affidavit was in <br />order and a bid bond in the <br />amount of 5% of the bid was <br />submitted. <br />Bid was signed by Robert V. Batteast, <br />non - collusion affidavit was in <br />order, and a bid bond in the <br />amount of 5% of the bid was <br />submitted. <br />$36,205.46 <br />McIntyre & Jones Bid was signed by Kenneth A. <br />2526 West 6th Street McIntyre, non - collusion affidavit <br />Mishawaka, Indiana was in order, and a bid bond in <br />the amount of 5% of the bid was <br />submitted. <br />$29,698.00 <br />Rieth -Riley Construction Bid was signed by Richard D. Ruhlman, <br />P. 0. Box 1775 non - collusion affidavit was in <br />South Bend, Indiana order, and a bid bond in the <br />amount of 5% of the bid was submitted. <br />$29,488.63 <br />Upon a motion made by Mr. McMahon, seconded by Mr. Hill and carried, <br />the bids were referred to the Engineering Department for review <br />and recommendation. <br />VACATION RESOLUTION NO. 3498. 1980 - CONFIRMED (BENDIX DR. & ALLEY <br />This was the date set for holding a public hearing on Vacation Resolu- <br />tion No. 3498, 1980, for the vacation of Bendix Drive from the <br />southerly line of the Conrail Railroad right -of -way to a point 489 <br />feet northeast, and the first east - west alley south of Linden <br />Avenue from Bendix Drive to a point approximately 135 feet east, <br />City of South Bend. The Clerk tendered proofs of publication of <br />notice in the South Bend Tribune and the Tri- County News which <br />were found to be sufficient. It was noted that letters had been <br />received from the various city agencies indicating that there was <br />
